    Default Egg PPI whilst self employed

    I've just gotten off the phone with an Eggployee. He confirmed that I took out PPIicon with my Eggicon card at the time of the application, and that I'd ticked the empty box for it with my own hand. He also confirmed that my employment status on the application form says "self employed".

    When I suggested that PPI was worthless to me considering that I was self-employed, he snapped back and said that "some aspects" of it may still have still been worthwhile.

    I asked him to send me a copy of the application form - which he said he'd do, but said it wasn't possible to send a copy of the TOS for the PPI.

    Do I have a legitimate mis-selling claim to make against Egg or not?

How good was that PPI insurance to you then? You pay a load of dosh to them and only some aspects of the policy may have been worthwhile.

    Do I have a legitimate mis-selling claim to make against Egg or not? Before I can try to answer that question I need to ask more questions
    1. Do you have the original Consumer Credit Agreement and terms and conditionsicon applicable to that agreement?

    2. Did the eggployee sent you a copy of the application form?

    3. If the answer to 2 was a yes, was it an application form or a true copy of the Consumer Credit Agreement as required by the Consumer Credit Act 1998?

    If you do not have a copy of the CCA you will need to start by requesting one along with all the other data applicable to you with regard to this PPI on this card.

    Post back and let me know and we can take it from there.

    Before you do have a look at this thread in stickies it may help you further to make a considered decision as to whether you have a case for claiming back your PPI.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    Eggicon have sent me a CCA, but it seems to have just been printed off on a laser printer - it isn't signed by me or anybody else.

    The Eggployee I spoke to yesterday told me that NO Egg card customer has EVER actually signed a CCA because they're all agreed to online using digital signatures. I told him I'd seen scanned copies of signed agreements on this forum, but he maintained his argument. I felt like he was either misinformed or was lying to me.

    FYI I took out my Egg card in 2000.

    Not yet - he said he'd send me a copy of the application form next week.

    I took out an Eggicon Card in 2000 and they have sent me a signed credit agreement, They say I took out PPIicon but it is not mentioned on the agreement.
