Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I bought a brand new Seat Ibiza in June 2006 for my nearest authorised Seat Dealership. It still has 6 months warranty left.
About 8 months after I bought it, a knocking/rumbling noise was audible from the front drivers' side, so I booked it in to the dealership under warranty. They told me that the front suspension bushes needed replacing, so they carried out the work under warranty.
About 6 weeks ago the noise came back, so I booked it back in. They had a look, but said they could not find a problem, so tightened the suspension screws and bolts. I was asked to see how it went.
The noise was no better, so I took the car back in on Monday. I received a phone call to say that there was a problem with the steering rack, and that it is a known fault on the Ibiza's, but Seat have not found a solution to the problem as yet. Apparently some are worse than others, and mine happens to be a bad one. Basically I would have to put up with it.
I said that I wasnt very happy, and that if I were to sell the car (which I was considering doing), who would buy it once they heard the knocking? (I know I wouldnt!).
I would like to know what my rights are, if any, as I really want to get this sorted out.
Your rights are to have it fixed under warranty. They may be hoping that the warranty will run out and then they can tell you where to go.
If it is a know weakness with the car as the mech says and they all suffer with it, then it is an inherent fault.
Normally when something of this age is claimed to have an inherent fault, it is up to you to prove that, but the mechanic has saved you the bother of another engineer having a look and you having to pay him and claim it back.
It is not too late to reject the car and have your money back - less the enjoyment use.

Yep, insist they put it right or you will get it replaced and sue them for the cost.
Put your claim in writting stating that it is a known fault and you want it repaired under SOGA and warranty and give 7 days to respond.
