Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Not sure which section this should be in so please move to relevant section if needed.I read in yesterdays metro(monday 8yh dec.front page), that thousands of people could either ge their loans wiped out or even get all their personal protection Insurance payments refunded due to an alleged mis selling, similar to the endownment mortgage fiasco years ago.The paper also stated that some companies are cgarging up to £500 to see if you are entitlrd to any money back. However, the C.A.B. said their advice is free. Now i don't rate the Citizens Advice Bureau, so that is why I have posted on here. Can anyone tell me anymore about these possible refunds and how I go about finding out if I am entitled to any money back etc.?Many thanks in advance.
firstly you need to get a copy of your original loan documents,
The most straight forward way to do this is to get yourself a postal order for £1 (do not use a cheque) and send letter N from here to your creditors
(do not sign the letter either - just either print your name block or use a nice font like lucida script) http://www.consumeractiongroup.co.uk...templates.html
send recorded delivery
within 12+2 days the lender should have sent you a true copy of the agreement
Once you have that - post it here and we can make a start....(remove personal name address and account numbers first_)

Ill just add do not be deluded by the term used in many papers have your debt wiped out that is not true and its giving the consumer the wrong impression yes the there are good grounds for getting your PPI refunded but it will not clear your debt unless the refund is more than the debt.
Im not trying to put the dampers on anyone but i feel consumers need the truth as the media does not always give the whole story.

I will post up a few links from links in stickies to let you make a considered decision on whther you believe you have been mis-sold PPI.
Can I reclaim on any PPI policy?
Your claim for compensation is dependent on when you took the insurance. PPI sales only came under the jurisdiction of the FSA on 14 January 2005. Any sales made before then are not covered by the latest rules.
However, it may still be worth complaining to your lender if you feel you have been mis-sold. If you bought before January 2005 it is likely that they will have been covered by a previous regime of rules. This means that the Financial Ombudsman Service will be able to consider these complaints. If you took PPI after January 2005, your claim is subject to the latest rules.
Quote:
When determining whether a policy is suitable, a seller – whether a lender or an agent for the insurer – must obviously take into consideration any information the prospective policyholder volunteers. However, we do not consider the seller’s duty is limited simply to recording what the borrower discloses. It is only by asking questions that the seller can properly determine suitability. These questions cannot cover every aspect of a borrower’s personal position and should not be expected to do so. To paraphrase the ABI Statement, only those matters deemed to be relevant by the insurer should be the subject of questions.

It is long but it does have a stack of useful information.
