    Default interim charging order on id theft

    hi i dont know if im posting this in the correct forum as iam new to this site. but i have recived an interim charging order due in court on the 6th jan 09. i have contacted the solicitors of tessa portfolio.who are taking me to court. its turned out that its for an Eggicon credit account for £13000 which i know nothing about as i have never had any dealings with egg.sounds like someones stolen my identity. ive had solicitors letters previous to this but i thought they was for some h.p. agreement years ago.which was in dispute.so they just got binned. i got my credit file today from equifax and i have a ccj. i have sent a letter to there solcitors today explaning. can anyone give me some advise on what else to do before the charging order is granted. thanks

    Hi danski32,
    first of all have you asked for a copy of the CCA which this cc refers to?
    if you have had you identity stolen then imo no judge would put a charging order on your property,
    you should start by writing to the CC stating that you know nothing of this account, put the CCA into dispute to both the credit card company and the acting solicitors, while the account is in disputeicon I believe they must resolve your complaint before any court action..Gc

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    hi caz thanx i already have wrote to the solicitors. please what is a cca i know nothing about all this. i have just got my credit report back from experian cannot undertand that one bit its all green, and some red bits its all double dutch to me. time is ticking any solicitors out there who will take my case on thanks..
