    Default Can i reclaim overpayments already paid back?

    I am currently disputing a claim that i owe some money to due to overpayments of tax credits. I still waiting to hear back of these.

    But upon asking for my Subject access requesticon i notice that i have had to pay back some money regarding a different overpaymenticon claim for a previous year.
    Basically tax credits where paid through my employer and this stopped.
    On my Subject access requesticon is states Employer paid using wrong Reference. So im thinking my employer paid this aswell as tax credits into bank. This was about 4 years ago. I had no knowledge of this at all until going through the Subject Access Request.

    Do i have case to claim this back as i was totally unaware and completely not my fault as the fault is seems to be communication between tac credit office and my employer or a mistake from employer.

    You can certainly claim it. Tax credits are inland revenue's responsibility and you have seven years to claim back anything due.

    Put it in writing with the evidence. If you don't want to send originals then get authorised photocopies from either the Jobcentre or Tax office.

    It might also be an idea to contact the local tax office to discuss your case first as local help often speeds through tax enquiries.
