I purchased a PS3 on the 23/3/08 at a cost of £310 with a coupon for 10% off at the time giving a price of £279.20. The pack included a free game.
The PS3 developed a fault in November 2008, I telephoned Littlewoods to arrange a replacement or repair, they told me they just collect and refund and then I am free to purchase another one.
They duly collected, took 14 days and added £3.95 to my account on the 26/11. When I telephoned to query this initially they told me that they had found that the unit was not faulty and where returning it to me, and that charge was for the unit being returned.
The unit arrived 5/12 with an enclosed letter; transcribed -
We have now received item PI958 you recently returned to us.
We have checked the package and found that it was incomplete. We have now returned it to you.
To enable us to credit your account please arrange for the complete item to be sent back.
A charge of £3.95 has been added to the balance of your account due to the additional handling costs that we have incurred.
I have contacted Consumer Direct and was advised the following;
That any remedy is at the traders cost under the sale of goods act and that they are not entitled to charge me £3.95 as the goods are faulty.
They must repair, replace or refund the goods.
That I have incurred loss of bargain because the cost of the goods initially was discounted and now if I was to replace them I would incur a greater cost because there is no 10% discount from them.
The area that was a little grey which they did not elaborate on was the fact that the game was missing. He said that they could reasonable charge you an associated cost for the game and deduct this from the refund cost, but this is only after they have not repaired or replaced the faulty item.
I explained that Littlewoods do not replace, or repair they just want to refund only. He told me then that it was unreasonable for me to accept a deduction after so much time and that they haven't offered anything else.
To be honest I have gone and bought one from HMV because I couldn't wait any longer for them to do something about the whole thing. So really I just want my money back now.
Does anyone have any further suggestions to make? My main concern is that they won't credit because the game is missing. The game isn't made any more, and as far as I was aware it was free. Since the cost of the consol alone was the same as the cost of the consol plus the game.
The free game was a promotional offer and must be included in the returned package or they can charge you full price for it.
