Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I've unfortunately been with Abbey for around 17 years, with the last 14 of them having an overdraft. Reading these pages has made me wonder if I could claim for any charges?
Also, around 6 months ago, I was charged £25 for a direct debit that had insufficient funds in the account being paid. Regardless of the fact I had cancelled the direct debit, and also informed the company who the DD was set up with that I had cancelled. Abbey let them take the money from the bank, and had also done so two other occasions before.
After speaking to someone in India, she said that as I had the other two charges refunded, I cannot have the third one. I explained that it was Abbey's fault that the account was overdrawn, after letting a company take money from my account, after I had cancelled the DD, and they had let them take it for the two previous months, all Abbey's fault. I explained that to take money from someones account without their authorisation in the UK was called theft.
All I was offered was a letter to explain why they cannot refund my charges. I have been on JSA for nearly two years, and £25 is a lot of money. So, I had to sit back and be told there was nothing I can do about it.
Surely they have a record of the date the DD was cancelled, then the dates the company took the money from my account, which would show it was taken AFTER I had cancelled? As I earlier stated, I did get the charges refunded on the first two occasions, but she said under no circumstances can the third time be given.
I just want to know if I can claim the £25 back, seeing as I am on benefits, and was at the time of the charge, plus if I can make any claims for charges over the last 17 years?
Hope someone can point me in the right direction to which thread to start with!!
Any member of staff in an Abbey branch can go on servicing portal and see when the direct debit was cancelled. If as you say you cancelled it before DD was due to go out then they could easily refund the charges, fill in a charges review form and note the reason for refund was 'abbey error' and that is as easy as can be.
