when me an my fiance an our 3 children went on holiday , my fiance's employer said that 1 of the days had 2 be unpaid as he did'nthave enough holidays left. so we said ok fair enough!! when we got back which ws in september!!, he never mentioned anything of it so that was that.
anyway now all of a sudden he wants to make my fiance work a weekend for 1 of the days he owes him?
apparantly he owes him 2 days and now when he is short of workers he just calls on him 2 work? is he allowed to do that?
also my fiance said no just take it out my wages, which his employer is happy to do as its christmas an there bonus's are due.
please help what are his rights????
Firstly you need to make sure that your OH does indeed owe them 1 day. Get them to check.
Secondly, if they do owe 1 Day then it would be fair to make this up but reasonably.
Either by deducting a days holiday from next year, working an extra day when she normally doesn't work etc.
If they have been asked to work two (2) days but only owe one (1) then this they do not have to.
Its easier to put it into hours rather than days as weekend days are sometimes depending on industry longer or shorter days.
So its best to ask "how many hours your OH owes" and then they can work back exactly what they owe.
Alternatively, if your OH has been paid for holidays not entitled to then it would be reasonable for them to be deducted from following salaries. If this is what they are doing then ask them to deduct the monies owed (1 or 2 days pay is not alot) over 2 months wages etc.
It is also reasonable not to expect your OH to work the normal days (normal pay rate) he owes on days that are considered "overtime days". ie Factory workers normally/can consider weekends overtime days with over time rate. What he owes must be like for like in terms of pay rate normally given.
Personally, if I owed 2 days I would ask for them to be deducted out of the wages or salary, if weekly paid ask for it to be over 2 or 4 weeks, theres no harm in asking.
