    Default Me V Creation Financial

    Hi all,

    I just thought I would write about a success (well I think its won but we will see) I sent them a letter about the PPIicon on my storecard account a week ago, spoke to them today - they confirmed they had looked into my allegation but were trying to fob me off with "its been on there for 4 years why have you only just noticed crap" I pointed out to them that I didnt care a jot how long it had been on there. I then asked them to comply with my requests and not only answer my questions re the sales process but to forward my signed agreement to this rip off - she came back to me and said they didnt have it!
    I then asked her to calculate the total premium paid, inclusive of interesticon paid on the premiums as well as the statutory 8% - she advised me this amounted to just shy of £250.00!

    I then spoke to an operations manager who again wittered on about its taken 4 years blah blah blah - when I pointed out that this was the equivalent of theft he did not like it, I also threatened him with court action - he then started going on about getting the original agreement checked, I pointed out to him that his underling had already tried that one and that they didnt have one - to that he answered "oh well it will be found in your favour then"
    So he has assured me that they will be in touch before 13.00 tommorow with a resolution and hopefully a full settlement

    I cant believe how easy its been so far and more to the point how they can have such inferior archiving policies - thinking about it I dont even remember sigining for the card!

    Anyway fingers crossed for tommorow, if any one needs any help with these cretins let me know!

    Hello well as I suspected they have coughed up!

    Had a phonecall from a "manager" this morning who was trying to defend again and put the blame against me for not raising this earlier bearing in mind that the PPIicon had been on account for the last 4 years. She banged on about proving it with the signed agreement again - I pointed out again that I was told yesterday there wasnt one - she said we will see. Got a phone callicon at 13.00 stating that they had processed a refund of £238.45 which was inclusive of the 8% statutory. When I asked about the fact that I had been charged 39.9% on top of the premium charged each month she stated that she would call me back with a recalculation - about an hour later she phone back and said that a further refund had been processed for £94.11 and that my account now had a credit balance and would I like a cheque for the credit balance! - Total won £332.56!
    Knew they didnt have a leg to stand on when they started wittering on about the fact its been on the account 4 years and I have only just raised it - Merry Xmas to me, and furthermore goodbye to Creation Financial!!!

    Anybody that needs any guidance in dealing with them (they are pussycats trust me) feel free to contact me

    Excellent news Cheshirelad,

    What a achievement, I must say, You didn't need to send a Subject access requesticon to get any information, or a request under section 77 to obtain a copy of your credit agreement, they just told you over the phone, they did not have one

    They then rang you and offered to refund the ppi payments, plus 8% interesticon and then increased it to their unfair extortionate interest rate of 39.9%

    How good has creation been in this matter, they must have had a severe warning from the OFT and the FSA regarding their previous handling of consumer complaints, in which they will completely deny everything and will be as evasive and unhelpful as possible.

    Thats correct - in my allegation of mis-sellingicon I also asked them to send me a copy of my signed agreement (no SARicon, just a further request in the letter) to prove that I had actually signed for the insurance - they dont have it so I guess it means they dont even had one for the credit agreement either. You are correct apart from the 39.9% interesticon on top of the premium - when they called with the first offer I had to point out to them that they needed to recalculate - which they promptly did with no argument whatsoever!
    An absolute walkover - I gave them plenty of grief over the phone also, I pointed out that I classed it as theft which they really did not take kindly too!
    I am still shocked at how easy it was!!!

    I have just had a very similar experience with Creation, no cca etc. but when I raised the question of 39.9% interesticon they said that they would not refund any more than 8%. I think it would be worth another letter - what do you think my chances are! If you dont try you dont get so to speak.

    I'm glad you got a response from Creation.

    I wrote to them in Sptember and complained about the PPIicon attached to a loan. I got a standard non commital reply but they did agree to cancel the insurance and refund the premiums from the date of my first letter...never heard another word from them!

    I'm not sure where to go from here, if i call them and manage to speak to someone, they say my complaint is bing dealt with and they are not able to discuss it with me. Plus, Creation were not regulated by the FSA when i took out the loan and are therefore being very unwilling to help.

    In my calculations they owe me £900 (total since 2004) and i can't see me getting a penny of it!!

    Any help would be great

    Theyre easy - my claim was deal with very promptly, If I were you I would simply point out that you had paid 39.9% on the premium and you want that as well - I mentioned it when they called with an offer and they ended the call then called back shortly later with a recalculation.
    Chelle - keep ringing and pointing out to them that they are being obstructive and not helpful whatsover, numbers I called on were 0800 012 1173. Let me know if you want any further info, they back down very easily if your confident enough with them

    I too found them very easy to deal with, the person I dealt with meekly offered a few arguments but I stood my ground and go the result that I wanted apart from the difference in interesticon but I havent finished with that one yet. Chelle keep ringing and pushing the issue and I'm sure you will get the outcome you want. Good luck let us know how you get on.
