Could anyone advice me, please...
I have an issue with Wandsworth council.
I received a pcn not a vile ago regarding Code 02 (waiting and loading restriction) stopped on DYL. Time was 20:00
What actually happened is:
I squeezed into the gap of SYL left I stopped very close to the car in front of me, so when the driver of that car decided to move off, I had to reverse (emergency situation as he could hit my car)and my back wheels stopped on the DYL.
I wrote them a challenging letter, so they reply to me with a acknowledgement receipt where they wrote that "no future action will be taken". But after 14 days of the PCN my fee has gone up to 120£. So they sent back letter of rejection and now I have to pay 120£. Unfair!!!!
It means that you have no rights to challenge ( you can't disagree...)
So I was trying my best to find a reason which would help me to win the case.
And I think I managed...
I believe that the road markings on street is illegal...
SYL without any marking turns into DYL. You can't see the beginning of DYL as it shown on High Way code for road markings. (little kerb at the beginning of the line)
Could anyone advice, please?
Am I right? And If yes, I will appreciate the link of the rule which regulates that.

But surely you were obviously still in the car and actually driving it or else how did you reverse it?!
How long hd you been sitting in the car before the other car moved off? Perhaps could claim contravention didn't occur as you were simply waiting for the other car to pull away and then park in the space he vacated.

can't comment on yellow lines based on a description. always need to see these things. that said, i wuldn't bother cos it doesn't sound significant enough to get you anywhere.
more interested in where you said you got a message about 'no further action'
Need to seee that. - or, better, full description of events and dates.

I stopped there for one silly reason: to make a phone call,
obviously when driver of the car in front decided to move off I reversed, but I didn't come back, so my back wheels where on the DYL, but still after 3-4 minutes I drove away.
Full amount of minutes spend on the street was no more then 10.
I will try to download pictures tonight when I get home.
But What I am trying to say:
first: they sent me pcn for a sake of few cm of double yellow
second: road markings is not cleared enough
third: "no future action will take place!", but they put up a fee of PCN.

Like i said, yellow line issue is not likely to help you. There is case law to support that view - but if you feel that it was very significantly wrong in some way then show it. Missing T-bars won't be enough.
i normally ask to see all of the pcn but i'm fairly sure wandsworth are compliant. Having said that I now realise i was thinking of directly served (on the car) Reg 9 PCNs.
yours is reg 10 by post so very worthwhile to show us ALL of it - maybe flawed.

The DYL ending is unimportant since it is not the contravention you are charged with its stopped on a loading restriction which may have carried on beyond the DYL onto the single line depending on the kerb markings.

I believe that T bars are very important, as they are on the high way code...
At least it gives ppl an idea where DYL starts....

Whilst not technically correct as required by the TSRGD surely having two lines instead of one would make it obvious it was a double yellow line?
The point I was making was that it would not matter if you was on a single or double yellow line if the loading ban covered both.

good for you! Unfortunately it is, as i said, highly unlikely an Adjudicator will agree.
as green said. loading restrictions are also relevant so pics of kerb blips and signage would help.

i suppose though - that if ultimately they want to argue that a missing T-bar is 'de minimus' then you can counter by saying that a few cm onto the double yellows is likewise 'de minimus' - only if the loading restriction was different though.

Date of pcn 14 of October
Time: 20:28
Code: 02 parked or loading in restricted street where waiting restrictions are in force.
Location: Smugglers Way, SW18
On the 22 of October, council recived my challenging letter
On the 24 of October I recived Acknowledge receipt( A full reply will be sent to you in due cource and no futere action will be taken untill then. )
On the 12 of November I recived letter of rejection.
PCN went up from 60£ TO 120£.
Why?
Unfotrunatly I can't upload pict, but on them you can see that on the first position ( at 20:33) i stopped on SYL.
And on the last picture (20:42 no car in front) when I reversed I entered DYL.
As I already said: few cm.
Restriction for SYL is Mon-Sun 7am-7pm.

No further info apart from actual images are going to help. I can see you are trying but it is just impossible to get the whole story without seeing everything.
Other people might feel able to help without.
For images you just need to host them on a site like 'tinypic' (recommended). it's fairly easy even for an IT numpty like me!
I can see what I think has happened but in no way will i comment without knowing for sure.

there is possibly a problem with that rejection that is relevant to the point 'green' raised. That's just starters but could be more - but need to SEE.
