hi, just been looking at some of the PPI threads after i recievd a phone call from a debt consolidator saying they could get my credit card PPI refunded, so i thought it would be worth looking on this very useful site!
I have maybe 4 credit cards, which i have had for ages, sometimes there was PPI on them and balances varied thorughout the years on them.
im not sure if i had agreed to PPI on them or not.
How can i go about reclaiming the PPI or can i even reclaim it?
any advice would be welcomed!

Hi h2bf have you got the original agreements that you signed? I did this for my OH with a Halifax CC and there was a tick box with a computer generated cross that had been put in after he signed the agreement. I was with him at the time of the application and they never mentioned repayment cover at all. They admitted they have done wrong but it is in the hands of the fos cos they wanted to pay what they had taken and put it off his balance.
i dont know if i have the original agreement form.
ill have to have a look later when i get home, all i know is that i took out a Halifax CC and that i have been paying the PPI i rang them last week to cancel it and they have. this card was taken out maybe 7 years ago... so im not overly sure. i have had replacement cards since though

A CCA request gives you the original agreement and costs £1. They have 12 days from receipt of your request to comply. An SAR gives you all of the details they hold on you (including agreement, telephone calls defaults etc) This costs £10 and they have 40 days to comply. I would just send the CCA request for now, it will tell you how you have been sold the cover ie tick box or signed for it. The CCA request is below. don't sign the request, just type your name. Send it recorded/special delivery and put a £1 postal order in with it.

This letter is a formal request pursuant to s.78 (1) of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide.
I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.78 (6) will apply.
If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties.
I enclose a postal order for the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.

Just do what I do rather than writing/typing them all out. R click on the top of the letter, drag it down till the whole letter is covered drag it into wordpad then fill in the details. It only took me about 3 years to work this out Yes this will give you an idea of how they actually applied the payment protection tick box (which is dodgy) or a signature. If your anything like me you don't read the agreement when you sign, you're just told to sign here and here!!

just going through my accounts online and found a loan i paid off a few years ago.. ill send them a letter too.
once i have sent these off ill wait for a reply and go from there!

I would write to them and tell them you never requested PP and that the tick box could have been ticked at any time, before or after you signed. This is what Halifax did to my OH. I wrote and stated at no time was PP mentioned and that tick could have been added at any time. They paid out

Hi Louis, don't know if there is a standard letter, I could dig out the 1st letter I sent to Halifax if you want. They replied to this saying he had ticked the box and it would have shown on statements, yada yada, so I wrote back saying it was pre-generated tick box and they had obviously ticked it as the cross was a computer mark and not his tick (does that make sense!!?) Just shout if you want the letter

no that sounds fine, i have another claim on PPI with MBNA so ill put together a letter explaing about the pregenerated tick and being mis-sold etc. hopefully the letter will suit both claims

i am sorry to hear of your concerns regading the insurance applied to your credit cards.

needless to say as they forgot to include it in envelope and i have not recieved it does bring me concern as if thats how they hamdle a complaint am i to think they will do nothgin, as nothgin was uspplied - if you get my drift...
lol any thoughts on this would be wlecome, on how to proceed further.
