    Default Confirm from Ombuds dept Re: PPI what now?

    Discovered 18 months on that PPIicon was added to my finance agreement Why? I hear you say did it take so long ... dealer has refused to provide my copy of finance agreement despite many many requests and when I threatened finance company (owned by car manufacturer) they sent a totally illegible copy to shut me up which is when I discovered that PPI was added so have not had the benefit of the statatury 10 day cooling off period in which this error would of been identified and resolved I was also curious as to why I had in addition to copy of finance agreement a PPI policy I never rec'd a policy certificate which once again would of alerted me to the PPI which the dealer had added despite ticking and signing a demands and needs form saying NO.My current position the dealer has as a goodwill gesture offered to refund the PPI only however as this is included on the finance agreement that figure generates interesticon charged over the term of the agreement which the dealer curiously has not mentioned Please advise what I am entitled to I have had a letter from fosicon which is probably the reason the dealer has responded with this offer I have contacted the finance company and asked about PPI policy certificates they informed me that they "We Do Not Always Send These Out?" once agai we are being denied the opportunity here to identify mis selling if I had rec'd my copy of my finance agreement or this PPI certificate I would of responded immediately sadly I never rec'd any. To rub salt in the wound the dealer manager has admitted that they have copies of my agreement I have asked him to forward a legible copy four times in a four week period result...Nothing Question can I ask the Ombudsman to make my agreement unenforceable?

    Have you mentioned all of the above to the Financial Ombudsman Service (FOS)?

    As for the goodwill gestureicon. If the FOS uphold your complaint then you should be entitled to receive the PPI premium plus the Interest they charged you on it over the lifetime of the claim and you should also get 8% Statutory interest from the day the loan started to the day it is settled. I would call the FOS to confirm this is the case.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
