Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
well if you read my first thread, i put my season ticket in for refund on 30th sept, 30th oct i had heard nothing so and my company had taken the remainder out of my wages, and say they had not received the cheque.
so on rang national express and queried it, they said that it had not been issued yet, and that i would have to go down to the train station to find out what was going on.
because of being ill i only managed to go to train staintion this week, i went there, they got on phone to the same peep i had rung and said the cheque was issued 24th oct! also, on my receipt it says that i should be getting £432.00 but the cheque issued is for £332.00, so i'm out by £100 coz the remaining my company took was £456.
anyways, i just dont knoiw what to do, they keep sending me in circles, the train station said nothing they can do, i said what if its lost in post and they just shrugged like 'tough luck'. i'm trying to get hold of their accounts dept but convenatly they dont have an exturnal number.
i am telling them all what i need to be dont, i need them to check if it has been cashed, if not then cancell the cheque and either issue a new one to me of let me have the cash. lol the staion rekon they cant cancell cheques as they deal with to many, wiped the smurk of his face when i told him i worked in finance for many years now and no matter how many cheques are issued it is very simple to check if they been chashed . . . what you think chque numbers are for!
so anyways, i haveone from customer services supposedly ringing me back today, becuse everyone in accounts is in a meeting so she cant get hold.
it really is getting a joke now, two months and an awol cheque and they are about as organoised as a monkeys tea party!
grr this is beyond the joke, basically all they are saying they can do is cancell it and reissue it to my ex employers, which means anohter month or two.
i need this money now, it being take from my wages means i'm left desperatly short and have bills to pay, i just dont know what to do.
The first thing rail companies do when you are in the wrong is to issue a summons, (mainly to bump up their fees), you must threaten them with the same response as they would you.
You should write to them (recorded delivery) and give them 7 days to repay you. You must bill them for the amount they owe plus 8% interest.
You should also tell them if you haven't received your refund within 7 days then you will issue a summons with the small claims court.
well thing is aparently as the cheque was from my company, they cannot canx it and reissue it in my name, only canx it and re issue it to my company.
i'm just going round in ciricles, i have to try and get hold of someone at my old company to check if they received it, if not to send me autherisation for the cheque to be reissued in my name.
so in the mean time i havnt a penny to my name, so of course looks like chrismas is cancelled for me and my family as its just gonna take forever, if they have to reissue it then thats another 28 days at least.
as far as they are conserned, they have sent the cheque so its outta their hands, not their problem.
