Not a problem.
As you may be aware, the banks are currently running a case in court regarding this issue, and because of this they have been given authority to suspend action on complaints regarding bank charges.
That is not to say that you should not apply - quite the reverse in fact.
However the only claims that they are paying appear to be ones where the claimant is claiming hardship. Not sure if you can, or want to do this.
If you issue proceedings in court the bank will simply ask for an ajournment pending the main trial and I have every confidence that this will be granted.
So - my advice for now is Register the claim as soon as possible (send the Subject access request, calculate the charges adding statory interest and write to the bank asking for the money back.)
Then unless you intend to, and can , claim hardship its a waiting game until the main case is finished.
Regisitering the claim now will protect your interests as they must stop the limitation clock once you have registered a complaint.
So - start the process rolling.

If you are unable to provide this data, I will accept a copy of my statements going back six years; I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law.
I look forward to your response within 40 days, as [insert name of bank]is obliged to reply under the Data Protection Act. If not I shall seek remedy from the Information Commissioner.
