Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Turns out virgin have been happily taking £15 a month out of my bank account for a long while now for and old dial up account i had at a previous address(i left there in 2001).The account was cancelled at the time but they say someone reactivated it in 2003 and it looks like i've been paying £15 a month since. All they have done about it is credit my account by £75 and are basically saying tough luck!!
Can they do this?
Nope unless its someone that knows your details and used them saying they was you did you leave any letters or anything with your full name and address on it behind at the other house when you moved
Advice: wouldnt trust virgin media anyway they try taking money from you in any way they can.
My brother had a debt with them he never paid his debt and a virgin media sales person come around saying im here today to hopefully give you your service back and clear your debt so i took it up he took the £30 for it and the old box to bring a new one and never returned again so luckly enough i got his phone number as he tried doing a runner so i phoned him and said we have received no new box therefor have failed to supply the promised service so i would like my money back so he had to come back with it the lil teeth was nice try tho but didnt go as planned.
Found out my brothers debt kept going up because one wire was connected so they said so i disconnected the wires inside the house myself and have received nothing more instead his debt started going down and no more letters got sent so i take it as cleared without making a payment after the sales persons trick backfired
it was my ex who stayed there when i moved out in 2001.No payments were taken in 2002(moved back with my parents) and the payments start may 2003 for £29 a month. In may 2005 the payments jump to 2 payments a month without my knowledge or any form of statement for the second payment(which i now believe is a dial up account at the old house)
and then in march 2006 it jumps to 3 payments a month?
Surely if they were claiming these payments, they would have to provide a statement for what the payments were for?
My ex left the house jan this year but the £15 a month payments have continued. The £75 they have offered me is because all ntl accounts went over to virgin in may 2008 and they only want to recognise it back to then.
I have every payment written down from may 2003 but i dont think i dare add up to what it totals!
1st I'd just like to say 5 years!!! How have you only just noticed it?
2nd I'd like to offer some constructive advice
S.A.R - (Subject access request) them (modify the S.A.R letter from the bank templates) with £10 cheque/postal order. Find out what you have been paying for and how much it has been. Reclaiming this amount should be doable if you terminated your business relationship with them in 2001. I'm sure someone here will be able to offer some advice on how to reclaim it.
It may be worth talking to your bank about reclaiming the whole sum via the DD guarantee scheme as this is designed to stop fraudulent transactions... I think they'll probably say something like "you allowed it to go on for so long that it's your fault" but ya never know, they may be able to help!
