Warning Notice Received - Newbie need advice please
HI Everyone,
I've received a yellow card warning notice from Allied International Credit, saying that we need to pay £3,118 immediately for their client Ulster Bank Ltd. Have obviously been reading other threads and understand that I need to send a CCA letter to AIC - but my query is that most people know what the debt is for, I haven't got a clue what this is for - should I still send the CCA letter? And if they dont get back to me in the set time (is it 12 days?) then can I just forget about it? Is there any chance that this could be a [problem], or are they usually genuine debts, not really had any experience of anything like this before?

All advice would be great. Thanks
Check your credit file on experian you can get it onlien for free for a 30 day trial period as long as you remember to cancel it. This will tell you when it was incurred. If its not there then it may be a statute barred debt

If you genuinely don't recognise this debt or have never had dealings with Ulster, then it's likely this is a fishing trip, maybe for someone with the same name.
You could send them this:
Dear Sir/Madam
You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.
I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).
I am/we are familiar with the Office of Fair Trading debt collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.
I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

Have you ever had any dealings with Ulster Bank? It's unlikely unless you have lived in Northern Ireland, as Ulster Bank only operates there (it's HBOS in a balaclava, if you weren't already aware), If not, this may well be a phishing trip by AIC.
In my view the first action is to write to AIC telling them that you are not aware of any debt to Ulster Bank and you require them to provide you with full details before you will enter into any further correspondence. Don't give them your phone number and don't talk to them on the phone, in any circumstances. AIC are an appalling bunch; you will need to be robust with them.
A CCA is only useful if the debt relates to an unsecured loan or credit card, so finding out whether this is your debt, and what it relates to are the first priorities.

No, as far as i'm aware i've never had any dealings with Ulster Bank. Thanks for your advice. Will send the letter that Michael suggested and see what happens.

Statute barred is where a debt has not been paid or acknowledged i writing for six years or more. The creditor is not able to enforce the debt though there are exceptions to the general rule. It would not show on the CRA because it would be more than 6 years since the default.
