I purchased a chain & a bracelet set for my wife last year for christmas. It cost's in the region of £150. We have had to take the chain back because it has broke (16/11/08), h.samuel have sent it off to see if it is a manufacturing fault or weather my wife has broke it. She has only had it on about 20 times. We have the reciept and its less than 12 months old. When we took it back to the store they never even offered a refund or replacement, they did say that would possibly have to purchase a new chain.
Can some one tell me if jewellry is covered under the sale of goods act.

i have spoke to consumer direct and they have said that i have to prove its there fault because its more than 6 months old but less than 12 months old.
CD are correct - it is for you to prove the case. Part of this may involve their own report. What did they say WAS the problem, if at all?
The only other thing you can do is to get your own report and hope that a court will prefer that one above HSs. Whilst not necessary, it will be the best way of proving your case.
However, if you are unable to prove your case, you will lose. You may want to consider whether that is worth pursuing your rights.
But before all of that I would ask them what they believe the cause to be and the reasons for it.

But the law is crap, went to three independent jewellers and the all agreed that it was a manufactoring fault. But no one of the would put it in writing because they dont want the hassel. And consumer direct arnt much help either.
but on a good note ive won, its amazing what you can get when you warn them about legal action.
