Thread: car parking enforcement angency

hi everyone,

i was wondering if somebody could give me some advice. i parked my vehicle in a pub car park which clearly displayed signs that parking was for patrons only and that non customers vehicles would be clamped.

i new i was only going to be a few minutes because i was going to drop my son off round the corner. i took a chance and upon my return everything was fine, no clamp or ticket and i drove home.

5 weeks later i have received a letter from private car parking enforcement angeny stating that my vehicle was issued with a parking charge notice and as i have not paid it, it has increased to £85.00 and also if i do not pay this within 14 days it will go up to £135.00 and if i do not pay the debt it will be registered at the county court and bailiffs will take responsibilty in recovering the debt.

Just ignore them. Is this Parkforce by any chance?

the letter is headed private car parking enforcement agency and it looks official. it also has my details and my car details on it.

Whatever the name of the company, still the same old rubbish. Post #3 demonstrates how they approach getting their monety, which is to dupe people into thinking that it's a real parking ticket.

I could buy my 3 year old son a "my first traffic warden" set from Toys R Us and he could slap a ticket on your car with the same validity as this one.

do i have to pay as they never issued a ticket in the first place. or will thay just say they did. i was thinking of saying that i went in the pub but i suspect that cctv has evidence to the contary. however the cctv will prove that i was never issued with a ticket.

please help....

There is no debt. They will go away after 3 or 4 letters. Looking at their website where they call their tickets "Penalty Charge Notices" - it's clear they're not planning to go near a judge any time soon. They'd be laughed out of court.

Relax. It's a [problem] - private companies have no power in law to issue fines. They can only recoup actual losses they've suffered, or prove beyond doubt that a fair contract was in place that was agreed to.

Both of these would require small claims court action and no company wants to pay £60 to go to court on the off chance they'll win, because the chances of them doing so are absolutely miniscule. No company would stay in business long doing that, so it's a percentages game. 40% of people will probably pay up, the rest will get a few scary letters before they give up.

All you have is an unforceable invoice.

• do not pay
• do not contact them
• they will give up and go away after 4 or 5 letters if you ignore them.
• ignore their threats and lies about CCJs etc.

CCTV is irrelevant. They just mention it to scare you into paying. They won't waste their time pouring over CCTV tapes, preparing evidence, going to etc. etc. These companies are bottom feeders, not firms of lawyers.

Why do you say not to contact them ?
Surely if its an "unenforceable invoice" it's unenforceable even if you say I parked under the sign and did read it and thought that's a penalty so it's not lawful.

because that what they want you to do ! part of the [problem]. saves them 2.50 from the DVLA and the unwary may well admit things they should not. Keep them in the dark and let them spend/waste/ their money and then write to the RK then you use the links in Post #9. Their letter will transgress - its how the con works. don't stand for it and don't be party to it.

But if it is an unenforceable invoice, what could you admit to that would make it enforceable ?

If a fake £10 is a fake £10 no matter what I say or do will make it real so surely the same applies here.

I have no problem contacting them, the average victim however may signal acceptance in their letter as I think you know.. Someone emailed me this link G24 Ltd, CCS and successful appeal - where do I stand? - FightBack Forums looks like a good letter to me.

I was not playing devils advocate I was just asking a perfectly valid question.

whoever you are I refer you to posts #9 and #14. As I would all other readers. If you are the real Perky then take up the Pepipoo challenge. The court will answer your question and if it goes against you you could appeal to a court of record - something I imagine ALL PPCs would like to happen IF the PPC business is solid and has a case, and is still viable when the PPC actually does not breach legislation .

What challenge ? For what purpose ?

as Perky knows and as do many here a pepipoo regular offered to park at an arranged time in one his car parks so that perky could issue an invoice and take him to court over it so that Perky could prove his boasts were real and that he didn't just cherry pick and trap. Perky spectacularly failed to step up. The purpose as I see it is explained in post #17.

How can someone cherry pick and trap ?
I go back to my original statement if something is an unenforceable invoice then it doesn't matter what is said to who, the thing would still be unenforceable.
