Co operative Bank No CCA passed to Fredricksons now Moorcroft and now Lewis
Collegue at work had been on a repayment plan for sometime. All was going well until the Co op decided to start adding interest on again.
The payments were being made religiously every month, but the amount owing was getting higher as the repayment interest was higher than the payment.
CCA request sent to see if the agreement was in order, and no they have'nt on file anywhere, an agreement.
Usual threatening letters sent to his home, and my friend has offered buy the debt at the same price a DCA would get it for. They have said no.
Call today from Fredrickson International demanding payment immediately or they will take further action.
He calls me worried about what may happen. So thread started for comments and updates.
I have advised him to not talk to anyone, all correspondance to be done over the phone. No CCA, and the Co op are in default of a CCA request made some months ago.

not me personally............... ...but your friend is along way from any court action etc being initiated. If it was CL Finance for example it would be a different story.
It is unlikely that CoOperative have either a enforceable agreement or a valid Default Notice - in which case any court proceedings would ne ineffective.
Did your friend send a SAR request at same time as CCA? If not do one asap as that is the only request where they have to provide a copy of the signed agreement rather than a reconstructed "this is what it would have been if we had one" version under s.77-79 CCA

In the letter i saw the other day, they have admitted that they have No CCA at all.
S.A.R. was sent quite a while back, but there were no charges. The account was on a repayment plan, ticking along quite nicely, then they started to add interest again. This interest is more than the payment made on his repayment plan.

Then they will be unable to enforce anything through the courts. Any payments your friend makes are now classed as voluntary payments and are not recoverable.
If he works out total amount borrowed and then total amount paid back he will probably have repaid capital borrowed now. He can try a F& F settlement offer but these Creditors are bullies these days even when they don't have an enforceable CCA.

He did offer to buy the debt at the same price a DCA would get it for. Now he will dig his heels in and tell them to buzz off, especially after wrecking his credit file now.

Ok, Fredrickson have sent letters demanding payment. Letter sent back explaining to them that there is no CCA and the account has been in dispute since January. . .

The only difference is that we didn't receive a letter from Fredricksons saying they'd closed the file. Moorcroft just sent us a letter demanding payment, and we only realised last weekend that Moorcroft now appears to own 3 unenforceable accounts. 2 from TSB are with the Financial Ombudsman (TSB admitted they don't have agreements for either of them), the Coop only provided an application form. As Moorcroft don't like sending niceties such as deeds of assignment, I expect we'll be collecting their threatograms for a while.

Had a text from my collegue. Moorcroft on the phone this morning. That makes 7 calls in 2 days. They haven't received the Buzz off letter, so it has been emailed to them.
My collegue has no agreement at all, not even an application form.

We sent them a CCA request re. the Coop 'account' on 14th February. Have had no reply as yet. Delivered 16-2-09.
(If this helps - We sent them 'bemused' letter re. TSB 'accounts', even told them they were with fos, but they're still chasing. Only conclusion we can draw is that only a request for CCA stops them, and that it doesn't matter if you've asked the previous DCA(s) for a CCA. The same thing happened with Credit Security Ltd, only the CCA request seems to stop them.)

subbing - co-op have sent me two copies of my application form with no terms (interestingly CCA copy is two sided whilst SAR copy is only one side). No replies to letters, and only contact is them phoning to ask if I've received their latest I/E form
