Good morning all and heres a new one for you. In the month of may, due to the bank holidays i was paid a day late on 2 occasions from my company. This resulted in a few of my dd's/so's being reurned unpaid.Lloyds decided--Lets charge him £160 in charges for not paying his bills!!
I visited the bank and explained the situation they replied " its not our fault"
This morning i have found myself 140 quid over my agreed o/d because of their charges.
I think the only people who make money faster and for less effort are Camelot.
If this is the only time it has happened (as if!) and there are no more charges to reclaim then I would send a stern letter reminding them that these charges are unlawful and you expect a full and immediate refund. However, if like the majority of the rest of us you have many other charges then:-
1) Request statements (if you do not already have them)
2) Calculate charges then request full refund of all charges
3) Send LBA (letter before action) if you do not get a refund
4) Send reminder (optional I would think but it shows you have attempted to settle without resorting to legal action)
5) File claim for charges plus interest

The Bank has a policy on refunds and that means that because your employee paid you late the Bank is not at fault for the items being returned. Yes, as you may see from this site, you'll get the charges back
received a letter this morning saying "how sorry we are to hear that your not happy and one of our assistant managers will investigate your concerns which should be completed in the next 2 weeks.We will then be able to respond to your complaint in full at that stage and hopefully resolve the matter between us"
well just to let you know i received a phone call this afternoon from keith boman, saying that a letter was sent to me this afternoon. i asked what the content of the letter was to which he replied " i beleive a full refund was offered" good for me, shall wait and see and keep you posted
Sorry, just did a double take. Let me get this straight - Keith Boman is suggesting to you that Lloyds are offering a full refund well before you've had to file a court claim?
Blimey! Good news if true, but don't hold your breath - standard process for Lloyds so far has been completely the opposite!

Well as promised i received me letter offering a refund. It read:
Your concern regarding charges levied on your account has been passed to me by your branch for response and i am sorry that you have had to take the time to raise the issue.
As i understand it your pay has dropped dues to illness and a number of items have been reurned unpaid on your account. you also have incurred charges on occasions where your account has gone over the agreed limit.
When you become a customer we give you details of charges levied to your account for the day to day running of it. you accepted these terms when you opened your account and again when you arranged your overdraft with us.
With regard to the question of your pay being late due to bank holidays, most employers are well aware of this and usually arrange their payrollsa day early to arrange for it.However in recognition of the fact your pay was 1 day late i am willing to remove the £35 charge that would of been charged to your account on 1st august.i am sorry that i will not be able to agree to refund anyother charges which have been correctly applied.
I hope you feel i have made a fair decision but if you wish to talk about any of this please call me on 0121 600 3053.
If you are unhappy with my desision and feel that you have something to add which might change the outcomeplease get in touch.if we cannot agree on a soloution at that point i will help you refer your complaint to the finantial Ombudsman service for indipendant arbitration.
I am bound to say that the onus is on your company to pay your salary on the due date. They are already almost a month in arrears when they do pay you anyway.
As they have failed to keep to their part of the bargain, they are the ones in
breach, and liable to make restitution. Of course that would be a lot easier for
them to comply if the banks were not so damn greedy. I appreciate it is also
difficult when they are your employers, but they are the ones that are at fault.
so do you rekon i should cahse the company for it then instead?? either way its not my fault i have been charged unfairly i think.
No , the bank has still charged you unlawful penalties you can follow the steps and reclaim them.If you start with a SAR - (Subject access request) then you may also find other bank charges over the past 6 years,well worth the £10 it costs.

Just had lengthy discussion with an assistant manager at Lloyds birmingham, was offerered £65 and told "I'm not prepared to discuss technicalities of times and paperwork" . Told em that maybe a judge would like to discuss the matter and then tell you to refund me charges.
