Re: help ,son brought car ,and before he got keys, was told chassie,is f
all are know son brought car from dealer ,then ,it was sent some where to be done up and mot it was them who said that the chassi was f///.went back to garage, they said sorry, company policy is car sold as seen.he did not even touch car keys
Re: help ,son brought car ,and before he got keys, was told chassie,is f
Does he have a receipt? No such thin as sold as seen.
He is entitled to complete refund under SOGA.
Where is the car now? has he got anything in writing from the dealer or the testing station about its condition?
Once you have something in writing from MOT tester or garage then you can claim refund from dealer.
Re: help ,son brought car ,and before he got keys, was told chassie,is f
Ok, then.
Your son needs to write to the dealer stating that he rejects the car as unfit for purpose, not of satisfactory quality and not as described under SOGA1979, and demand immediate full refund. Also to tell them that it is their responsability to collect the car at their expense, and remind them that "sold as seen" has no basis in law and is in fact an offence as it is an attempt to deny a customer their statutory rights.
I wish all car cases were that simple.
Apologies to people who I was in the process of helping, I may be gone some time.
I already got told off about replying to this thread, so I have to be careful, but it's a double post from the Vehicle Retailers and Manufacturers section.
There is something distinctly odd about the whole thing in my opinion.
Quote "The chassi is F/////" Is this a new technical term I've never heard of before?
Re: help ,son brought car ,and before he got keys, was told chassie,is f
and Bookie, OMG, 'What's a TVR'
I was going to say that.

Re: help ,son brought car ,and before he got keys, was told chassie,is f
When you mentioned that your son never even touched the keys, I assume that you meant that he bought the car, paid for it, then the garage sent it off for an MOT/check-up and was then told that the chassis was knackered and the car was written off?
If this is the case, the garage is obviously trying to pull a fast one. Don't put up with it. Like Bookworm said, 'sold as seen' is a load of cobblers. £7,600 is a lot of money. Your son needs to make it clear to the garage that he knows his rights and won't have any qualms in taking them to court. When they figure out that they've been rumbled, I doubt they'll stand their ground.

His £7,600 is not down the drain, it is very secure and wrapped up in regulation that says "They must give you your money back".
Have you spoken to Valley Breakers yet ?
