Slightly confused about whether I can claim for hardship. Have looked at letter and template and not sure what needs to go in the left hand side of the spreadsheet. If I can't put anything in there does that mean I can't claim hardship. I've not got enough money coming in to pay all the bills and I'd probably get a job in a circus as a juggler, I'm also paying so much back to Lloyds every month to cover an unplanned overdraft.
There is 3 of us in the house with only me working and no other money coming in. A&L are also charging mega bucks again (have stay on this one). Don't know quite which way to go and whether to make a claim against Lloyds again. Took easy pay out last time.
The FSA have stated in their waiver- a)Lack of funds b)failing to pay c)Regularly going over overdraft limit amongst other things that need to be taken into consideration when contemplating paying out under hardship rules. They also state if you occur >£500 in charges over 12 months this is to be treated as indicative of financial difficulties. I was charged £487 in one month This is how I got mine back off the Halifax albeit it was paid off against my accounts but you can write to them stating what the FSA have stated re the waiver. Thanks Fedup - Do I need to write to Lloyds because their charges are forever taking me over planned o/d (not my main account) and put in another claim for unfair charges as well. My main 'wage' account is with A&L who the stay is with and is also charging so do I do the same here? Surely you can't claim 2 hardship cases?
Do I start a new charge claim with Lloyds as well as hardship? and with A&L does the hardship claim go from original claim plus new charges or are they both separate claims?
If you are claiming under hardship rules can you not just add the total number of charges and put it in as one claim under financial hardship (send the total amount of charges to Lloyds and one to A&L) My claim was stayed but when I applied under hardship rules, I just added on what they had taken since it was stayed, pending the outcome of the court action with OFT, and they paid up without interest, but they know I will be going after interest soon!!
