Hi all,
I have just bought an 07 Passat estate from a main VW dealer.
It was fairly cheap so I was a little cautious.
I asked the dealer why it was cheap and he told me it had been on their books for some time and if it was not sold soon then VW would fine them.
I specifically asked if it was an ex hire car and was told NO it was an ex VW fleet car owned by VW.
I bought the car.
I have just received the V5 and discovered that the previous owner was Avis.
I would not have bought the car (or certainly not at that price) had I known.
I am really angry at being lied to!
I have spoken to the sale manager (not the chap I bought the car from) and he said he will investigate and get back to me. (talked about offering me a replacement car)
where do I legally stand. I feel that I have been mis sold the car.

What was the mileage? would that of not raised your suspicions?
High mileage low price! thats how it works.
However if you feel the car was misrepresented following your questions and the answers given then you would be able to reject it under SOGA, and you should get a full refund of all monies paid.
any fleet car will be serviced exactly as the service schedule and they can have money thrown at them for repairs. i will give techs parts straight away for lease vehicles as we just know it will be authorised, but the private driver will probably um and arr about work that needs doing and shop around. so is it really such a problem with a fairly new low mileagevehicle, which as you say was a bargain?

any fleet car will have money thrown at it. When I cad company cars anything but anything went wrong it went straight to the dealer- not my money but "my" car.
Hire cars are driven by people who do not care what happens to the car.
there is a saying
"whats the fastest car in the world ? A hire car"
your argument about a private owner does not ring true with a 1 year old car. it will be a) under warranty, b) be his/her pride and joy.
I have no problem with fleet cars (this is what i was told it was) this is why I bought it.

I have a bigger problem with being lied to and being sold a car in direct breach of the sales of goods act.

9500 miles doesn't sound much like a hard life. What's the difference between an ex hire car and an ex fleet car? - they are both driven by people who don't own it and therefore theoretically might not give a to$$ about it.
What is your desired outcome over this? The sales manager already sounds like he's prepared to help.

Well don't ask for advice or opinion if you are not prepared to hear stuff that you might not want to hear. Jeez .......
If there is nothing wrong with the car then Its up to you what you do; it sounds as though the dealer will co-operate anyway. You would be pretty well covered for any major defects under SOGA anyway.

Without getting into an argument....
Actually i didnt ask for opinions. I asked for advice on where i stood legally. I know everyone has ( and is entitled to )their own opinion. It is all subjective which is why i didnt ask for opinions. some people will not care that they were misled some will be even more angry than me- we are all different.
