Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I sent a CCA request ltsb some time ago but haven't received a reply and I know they have cashed the postal order. For the last 2 months they have taken payments dirctly from my bank account with them (£275 last month and £175 this month). I know from other threads on the forum that they can do this, but surely they shouldn't be able to do it whilst they are in default on my CCA request?
Not sure what to do next with this - wether to send them a reminder for the CCA to show I'm being reasonable etc if it went to court (and I would do that s LTSB have made my life a complete misery for several years now) - or do I send them a letter telling them they are in default and I'll report them to everyman and his dog if they take any more payments without any authorisation? I think I've seen a letter on one of the other threads which I could probably adapt, if this is the best option.
Hi Popeye can you not open another bank account with someone not connected to who you owe money too. I see what your saying about it being in dispute, but you must realise by now that these banks and DCA's can do anything they like. If it was me I would open a different account and get your money paid into this, at least Lloyds can't get their grubby little hands on it
Thanks for this - for some reason it's never crossed my mind just to open anotehr account ! D'oh....
I do have an old Nationwide account that I could probably use, so I'll look into that this week. Presumably, I then just tell Lloyds that they aren't getting any cash until they come up with the agreement?
I can't tell you how unhelpful this lot have been. I've had this account with them for over 20 yers, had numerous loans etc. They won't give me any type of overdraft (probably becasue they are making about £200 in bank charges etc - usually as a result of excess drawing of between £5 - £10). I've written to them 3 times to ask them to freeze the card interest and acceptt payments as part of an overall debt management plan and they haven't even had the courtesy to reply.
And weirdly they can't find any details of an old credit card I want to reclaim charges on - even though I've got letters etc from SCM threatening to take me to court about it.
Moving everything to the Nationwide seems such a good idea, I wish I'd done it ages ago !
