    Default help with sra and ppi

    hi there

    i recently sent off and sra and cca reqest to barclaycard....

    they have sent me 12 months statements and claim this is all they hold regarding the account.

    i want to claim back PPIicon and charges but not sure what to write back as i have had the account about 5 years and since they have not sent all statemnets am unsure of how to proceed.

    any advice welcome

    Send another letter informing them that they have not complied with your request as they have not supplied everthing they hold on you.

    As they are failing to supply this information under the data protection act 1998 this link below will help you.

    i recently sent off and sra ( I think you may mean SAR (Subject access requesticon) and cca reqest to barclaycard....

    they have sent me 12 months statements and claim this is all they hold regarding the account. (this is highly unlikely press them for full disclosure of all the information they hold in their records on you as a Data Subject. Warning them that failure to disclose will result in a formal complaint to the Information Commissioners Office for failure to comply with the Data Protection Act 1998.

    If they have failed to respond to your Subject access requesticon (SAR) and you must remember they have 40 days to make a full resonse. Then you can go to Court and follow pompeyfaiths Link in previous post. And/or go via the ICO route and also complain to the fosicon, FSA, OFT, Trading Standards and anyone else you think of that could help or make notes about their behaviour.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
