Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I need help with my dept please, i can not sleep anymore!!!
Loan Natwest 18,000, Loan Northen Rock 22,000, Loan Cahoot 8000, Natwest od £5000, Barlays loan 6000, Mint Credit card 11,500, Egg loan 8000.
I have full time job and other income totalling to £3000 per month, with family of 6 i only have about £80 left to split accross the creditors. i have been paying all the creditors approx £1500 every month for the last few years and can longer afford.
This week i have cancelled all direct debit!!!
I'm in Total mess and not sure where to start. ideally want to settle many as possible at around 20-25% settlement or avoid many as possible if i am to be debt free this lifetime. I can not afford to settle all at same time, will try to get help & borrow from family and friends to pay off.
I have no ideas what to do next, should i write to the creditors with a proposal? request CCA now or later please please advise.
Hi there, first of all relax, it is alot of money, but we have seen alot more, I think that your first port of call would be to cca all loans and credit cards, dont forget to attach the £1 postal order and do not sign the letters, or at the very least, have a special signature for these letters.
When you have received them, scan them, remove all distinguishing marks and let us take a look and see what we see, chances are that most of them may not be enforcable, it will put you in a stronger position and you can decide what you need to do after that.

Lula , thanks for your advice much appreciated, there are many different template letters for requesting CCA - do you recommend any. Also should i put the line "i don't acknowledge the debt" at this early stage.
What is the status of these debts?
Are you in arrears with them? If so how far.
Are there any court proceedings pending or do you have any CCJ's?
Do you live in rented or mortgaged property? Do you have any equity if mortgaged and if so how much?
Hi and welcome, Here are my suggestions at this stage,
1 get a bank account with a bank NOT connected whih any creditors, pay your income into it, set up DDs for your priority bills/secured debts only NOT the unsecured ones.
2 contact CCCS to help you set up a payment plan, this is a free service.
3 when this is setup/running, start to send CCA requests to them
Please note i have no legal training any advice i give comes from my own experience and from what i have learned on this site
It is amazing how accommodating these companies can be once they realise that you know the debt is unenforcable.
Now, I am not saying that you should avoid your debt, but what I am saying is that you can learn the truth of wether the debt is unenforcable and then you can negotiate with the company to be able to pay off something that is affordable, and have them freeze interest etc.

Also, it there anyways to have IM chat with any of the forum members
Theres no IM, but there is private messaging, however, its not used a lot because we like to keep the discussions open so that other users can benefit from them.

Hi, I have been in contact with CCCS to set up dmp, they are not intersted as my surplus is only about £200. please advice what i should be doing.
Should i request for the CCA now/ at this stage.
I have not paid my unsecured creditors anything for the past 2 months.
Did they go thro an income/expenditure review with you/, if so they should have sent this to you, to send to all your creditors along with a list of pro-rata payments.
This is a good thing, because you can now control the situation yourself, instead of cccs doing it.
if not phone them again, and ask for it.

Hi - I had similar problem and used National Debtline website - filled in budget planner on there and sent it to all of my creditors - most were obliging.
I used the template letter off this site regarding not being able to pay usual amount etc.
Then I CCa'd them all - up to now only 1 agreement has materialised.
I have found this site invaluable and am not advising you but just letting you know my experience
I too am new to this forum and have read with interest and I must say hope that I can remove myself from the financial mess I've got myself into. Unfortunately my partner knows nothing of my debts and I feel at least I can share my concerns with others in a similar position.
I have credit card debits amount to £15,000 (4 cards) any suggestions on way forward.

I can only say try not to panic. There is a large amount of information on this site and the site team are very helpful indeed. Make sure you keep copies of everything (mine are all on hard drive and then on memory stick in case of pc failure. Use recorded delivery - i have sent CCa's out - but take time to read the site.

Hi - just to tell you my experience - I moved banks as the charges made it so much worse. I am now out of the charges trap. If this is the same for you read the sections of this site about bank charges. It had got to the stage where they took ALL our money. There is also a budget planner on the site if you need to write to creditors to ask if they will accept reduced payments and freeze the interest. Don't panis and read up!!
