    Default Wants to claim PPI for Barclaycard due to unemployment

    Hi,
    I need some information and help before claiming PPIicon from Barclaycard. I recently lost my new job due to a bad verbal reference that was given by my previous employer. I was dismissed from my previos job on the grounds of gross misconduct although I have made an appeal and the issue is still under process. I worked for two years for that company and the very next day after my dismissal I was offered a job with a rival company but after three days my employment was ceased due to the bad reference. Can I still make a claim as I was not sackedicon from my new job due to gross miscondut? Any suggesions please? Thanks

    Can you explain on what grounds you are claiming mis-sold PPI?

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    Hello Alanalana,
    I think I have placed it at the wrong topic. It is not about the miss sold claim. It was about the actual claim I wanted to make for the services PPIicon are providing and what I had been paying for. As they say in there terms and condition If I am sackedicon due to gross misconduct they will not process my claim. I just wanted to know if bad reference does consider as gross miss conduct? Will they consider my ex job as the reason to deny my claim? Thanks for you help

    Hello Epman,

    They will deny any claim for payment of ppi if they can get away with it

    Do you have copy of the terms and conditionsicon of the policy?????

    I would put up a new threadicon on this forum, there may be guidence and assistance for you.

    What is not covered?
    We will not pay benefit for unemployment that occurs under any of the following circumstances:

    - where you knew you were going to be made unemployed, or you had reason to believe that it was likely to happen, at the start date; or
    - where you have not been in continuous work for 6 months with one or more employers immediately before your employment ended (if you were not working for 2 weeks or less, we will not count this as a break in your employment); or
    - your conduct (including misconduct such as fraud, illegal activity, dishonesty or anything that led to or might have led to a disciplinary procedure), your resignation, any unemployment of a voluntary nature, or where you have taken early retirement; or
    - where your work is seasonal or temporary and in both cases unemployment is a regular feature of your work; or
    - where a fixed-term contract reaches its expected expiry date unless you have an employment history with your employer and none of the above circumstances apply.
    Subsequent claims
    If you become unemployed (for example following a period of temporary work) within 3 months of a previous claim and we have not paid the maximum aggregate amount allowed, we will consider your claim as being part of the original claim. We will continue to pay this claim as long as the aggregate amount is not more than the maximum benefit we pay. We will waive the requirement to be continuously employed for claims that occur within 6 months of a previous claim.
