In Nov 2007 i spent a day in Stratford on Avon, I legally parked my car on the recreation ground car park. I purchased a 4hour parking ticket at 12noon which expired at 4pm and duly displayed it in my windscreen. 36mins later a parking warden placed a pcn on my vehicle for alledgedly not displaying a valid ticket!!!!
I appealed against the ticket, but received no response, however instead of corresponding with me at my address, they sent all correspondence to an old adrress as the DVLA had not updated their records.
A year later equitabailiffs turned up at my door to execute a warrant for the recovery of £365.49!!!
I have completed a Statutory Declaration and a Statutory Declaration out of time and submitted to the court which issued the warrant.
My current position is;- equita wont back off(I have taken to hiding my car) Stratford DC wont call Equita off.
I have viewed the photographic evidence taken by the parking warden at the time, and it clealy shows my valid ticket on view and then shows the PCN next to it!!!!!
Any advice please or anyone else had dealings with either Equita or Stratford DC
When is TEC decision due? Keep them advised. Keep bothering them for news cos last I heard they were running a bit behind. Continue to press the Council through ALL available channels. Make a formal complaint if necessary - anything to fend the dogs off.
Hope you get a favourable TEC decision mate.
Meantime, since this will probably revert to Notice to Owner stage can I see all of the pcn please - gotta funny niggling memory about Stratford. - maybe.

Stratford DC has now accepted my Statutory Declaration so are now re-issuing the Notice To Owner, however they still do not acknowledge the pcn should never have been isssued. At least the heavies from equita are off my back!!!!

got the message but finding it hard to access the sub-website. i don't particularly need to see your evidence anyway - happy to take your word on that.
what i need is all of the pcn and then the NtO when it arrives.

Update
I have now received a Notice to Owner which has been re-issued by Stratford DC. The contravention states ' parked in a pay & display car park without displaying a valid pay & display ticket'
I had, in the meantime written to Stratford Dc to make a formal complaint about their handling of my case. In the response, they admit to sending original notices to the wrong address, and have stated that ' The ticket I had purchased was not from a Stratford DC car park, but from a seperate private car park'
From my recolection of the carpark layout, there were 4 or 5 ticket machines within the area i parked my car and there were no notices on display stating that there was a private carpark located within the public carpark, nor were any of the marked as private machines private. I purchased my ticket from the nearest machine to my car, however i received a pcn as i had used the wrong machine, although all parking tickets were the same price/conditions no matter where i parked.
