    Default County Parking Enforcement Notice. Help!

    Hi People

    I have only just spotted this site, and it has eased my mind somewhat, but i would still like your input.
    I received a CPEA (County Parking Enforcement Agency Notice) on the 04/11/08. It was in a yellow wallet attached to my windscreen.

    I was parked in my flats allocated parking space in the underground parking. But i didnt have my parking permit displayed in my window.
    I was actually in a Courtesy Car while my own car (with the permit) was being fixed in a garage. I had actually only picked up the vehicle the day before. They are saying i need to pay the £40 fine in 14 days or it doubles.

    I immediately sent an appeal letter through with proof of my hire car etc advising that i could not get my permit cos it was locked in a garage somewhere overnight. I have not heard back yet whether my appeal was successful.

    I have since looked at this site and EVERYONE says not to reply back etc and admit anything
    I have of course now admitted that it was me etc and gave them my address.

    If i get a letter through saying i still need to pay, do you think its in my rights to ignore it because .
    1. it is not my actual vehicle
    2. it was MY Bloody parking space in the first place.

    I would really appreciate any input you may have.

    Your case is slightly different from a normal PPC car park invoice in that it was at your private flat parking. You could have used the "ignore" route just the same, but because it is your own bay I don't think telling them you were the driver in your own (admittedly hired) car makes a difference.

    Indeed, I suspect if it went to court, the court would look favourably on the fact that you clarified you were using the bay ligitimately at your earliest oportunity and gave them the chance to withdraw the ticket. I don't see a cat in hell's chance of them taking it to court and even less of them winning so just ignore everything else from now on.

    County Parking issues very 'poor' paperwork as I recall. At one time they used to put a 'lookalike' police badge on their paperwork which tells you a lot about their legitimacy. Do you own the parking space ?

    Hi Thanks for your help.

    I rent the flat, and with it comes two parking spaces, i just parked my hire car in their as i do every day.

    So is the reccomendation to just ignore any potential letters etc?
    They have no power to go ahead with any possible actions?

    did you sign a lease agreement that included the conditions of parking that this lot is imposing ? i.e do you have any agreement with them in in any form ?

    Lamma - Thats a good question, i have signed a lease for the flat, i shall have to check it when i get home.

    I know that there is a sign in the car park (cannot remember the exact wording) stating that a permit must be shown in the cars at all times.

    But surely the fact that my permit was locked away in a garage so i could not retrieve it has to mean something.

    I have checked my Lease, and can see no mention of any Parking rights etc.

    I will have to just wait and see, whether this parking company accept my appeal. Ill let you know what happens.
