    Lightbulb Trilby v NatWest (Business)

    As was suggested, I'm starting a new threadicon for my business account.

    Just checked through my business statements and realised that I had sent last year's lot to my accountants so will have to wait for them to return.

    For this one, I think I will go straight to the prelim letter as I know there are no missing statements.

    Not yet uk. But I know it will be quite a lot. Hopefully it will be below the small claims limit. Just had a quick look at the overall totals of interest, charges, arrangement fees etc over the past 8 years (since I started the business) and I have paid them an average of £14,000 a year so they have done quite well out of me. I have to say that about £97K of that is interest on the two loans I have with them, so quite legitimate, although I have had a few rows with them about it.

    As an aside - is there anything about overdrafticon arrangement fees on here?

    Poor soul - I am easily confused

    I have just re-read some of the posts so that I can get my act together with regard to reclaiming business charges - but there is a lot of conflicting information

    The advise by some seems to be that business claims will not get anywhere whereas others say to go ahead. One post talks of a new strategy but has not yet been added to.

    What do I do guys and gals?

    I'll move you to the business forum

    The situation for business claims is as follows:

    Bank charge claims have been based on 2 suppositions:

    1. bank charges are unfair under the Unfair Terms in Consumer Contracts Regulations 1999
    2. bank charges are unlawful penalties under the Common Law.

    The UTCCR 1999 do not apply to business accounts and the OFT test case judgement ruled that bank charges are not penalties under the Common Law.

    This leaves business claims with no basis in law.

    We are working on a new strtaegy but it is still untested. You will need to be patient.
