    Default Yet another problem PCN issued on ANOTHER car i used to own which i dont have!

    Hi all,

    Some may recall that i posted up about a problem that i had with JBW about a very similar case to what i'm about to explain again!!

    I received a letter for Phillips debt recovery agency in october 2008 demanding that i pay £xx amount of money for a parking fineicon on my car...which i no longer own....which DVLA have confirmed I have been removed from the records as the registered owner and for which I have not received any letters about as they was sent to an old address that I had moved out of!

    After a lot of two and throwing I spoke to westminster council advising of the situation about not owning the vehicle etc, and their advisor told me that I should send them proof of what I have about not owning the vehicle which was a letter from the DVLA. The advisor told me this would be ok...so i faxed it off to them and they said they would put the bailiffsicon on hold....I have a fax transmission stating that I had sent the fax and they had received it and they also said they would then contact me with their decision on what they want to do.

    Heard nothing more from them which was two weeks ago (I am under the illusion they have 19 working days...(one month) to reply i think)

    Had a bailifficon on my doorstep this morning demanding the money!! Also had no prior noti Rang westminster....apparently they hadnt received the fax....how convinient...especially seen as i know that their faxes go straight on to the computer and not into a pile of papers...so i know they cant just get "mis laid and lost!"

    Basically told the bailiff to p*ss off out of my house and that I would be in touch. Which he did.

    After a very long 'heated' conversation with westminster, which i recorded seen as they said not all of theirs are recorded (which I also know is rubbish as a computer records every one of them!) I quickly got no where! Westminster had now changed their story saying that the only way they can put the bailiffsicon on hold is with a stat dec...which I am quite happy to do...and did do today and got faxed. But my big issue is that they was still extremely un helpfull given the fact that the only reason I was in this situation with the bailiff was because of westminsters employees incompetence to provide correct information. Had i been told to do a stat dec back in october I woul dhave done so...but instead i have now had a bailiff visit due to their lask of knowledge on what information to provide. I asked them to listen back to the call in october with their employee so that they could also listen to what it was i was told to do...but the person i was talking to today (which was a manager) said he wont do that because there is no need to do so and that i should go do the stat dec and end the call now.

    So my question is this...would it be worth pursuing a claim for compensation against westminster council on the grounds of misleading information.

    Also is there anything else that I can do that will help me along with my out of time stat dec PE2 and PE3.

    Any help is much appreciated in this case

    When following threads like this and the many others which are just variations on the same theme, why does it always appear that it is the "innocent" motorist who must always prove he is innocent, and never for the council to prove he is guilty?

    Given the content of other threads it is beginning to become very clear that this is most likely not incompetence on the part of this particular Council.
