    Default Samsung Repair - Repairers smash telly screen on return

    Hi All,
    My aunt bought a Samsung 37" television from Coment back in July. It developed a fault whereby the television would intermittantly go to a blank screen even though sound would continue as normal.

    She phoned comet who said that she would need to have it repaired and a company called DSG solutions in Clydebank were requested, on Samsungs behalf to carry out the repair.

    When the engineers were returning the item to her and unpacking the television they discovered a large crack in the screen (which apparently happend in transit). They then said they would need to take it away again for another repair.

    My Aunt wants another television though as god knows what else has been damaged during the transit as its obviosuly not been transported correctly but Comet are adamant that she's not getting one. In addition the guys said they were unable to find the original fault.

    Does she have any rights here?

    Yes she does.

    SOGAicon allows for the retailer to repair or replace free to the buyer a fault inherent in an item when it was purchased.

    Any repair offered must not cause undue convenience, must be carried out with appropriate skill, and must be proportionate to the remedy of replacement.

    Whilst replacing a 37" is going to be costly, the screen has already been damaged in addition to the repairers failing to repair the original fault. Hence the repair has not been carried out satisfactorily. The option of a replacement is (in my interpretation) now legally possible should they wish to pursue it.

    If Comet are not doing this then I would personally write a letter before actionicon giving them 14 days to replace the item - or you will take them to the SCC.

    I would say that a replacement is not only possible but preferable. Not on expert on products, but I would imagine that repairing the screen would be quite costly, and your aunt has certainly been inconvenienced. This is covered under part 5A of Sale of Goods Act.

    incidentally, do you happen to own your own contracting business? Just that the name is rather familiar...

    I would agree - just trying to force it more subtly than implying he can just march in and expect a replacement.
