Do I accept barclays offer as part payment or do I hold off for the full amount
I have recieved a letter from Barclays this morning offering me £380 when my claim is for a total of £780.27. I am about to send the letter before action to them but I was wondering if I should change it to say that I will accept their offer of £380 as a part payment and NOT as Full and final settlement so that I at least have something if the rest of my claim falls appart but I was wondering if this is likely to affect my claim for the other £400.27.
What would other people advise???

Hi Lou, it seems everyone gets an offer around half of claim I accepted it as a part payment as you are thinking about but usually the offer is withdrawn if you continue with the claim..... accept anyway and see how it goes tho...... but hold out for the whole amount of your claim remember its your money and everyone on here is behind you with support...... Ok I'm sending the adjusted version of the letter before action off today. I have added "I will accept your offer of £380 as a part payment NOT as Full and final settlement." to the beginning of the last paragraph as well as the odd other word in amongst the letter so that it still makes sense after actually recieving a letter from them after 24 days (well they sent me a letter saying they'd respond within 4 weeks so I was giving them the extra fortnight from the first letter as it seemed daft sending the letter before action when I knew they had promised me a response.
Anyway letter now printed and on it's way to the post box!!!

Remember to stick to your timetable. The banks are perfectly well enough staffed to be able to respond to a letter in two weeks. The delaying tactics are another way of putting people off claiming.
If you get no further response from the lba in 14 days the file your claim with no further warning.

Hi I am in the same boat refused offer of £997,had curt letter back saying basicly forget it no more offers,I said see you in court but they have yet to send statements,can I proceed.

Are the statements late (i.e. more than 40 days after the DPA request)? I would wait for the statements just to confirm your figures are right.

Yes they are but I didnt send them recorded,as they have offered £997,does that mean that is half the amount they owe or was it just an amount they came up with

The offers made by Barclays vary but are normally just under half.
