    Default Secondhand car bought from trader on autotrader

    A week ago I bought a 2002 mercedes e320 cdi auto from a trader on autotrader but trades from home.I went and test drove the car seemed fine.I drove home no problems,next morning had problems starting a grinding noise from starter motor but did eventually start.next morning same problem but them as im driving gearbox doesnt change gear stuck in limp mode im told.I phone the trader and tell him the problem but he dont really want to know,just says do you know anyone you can take it to to have them look at it,and says the car was fine when i had it.That was it.Due to the all the computers on the car and sensors not just any garage can look at it so I did eventually find one that could have a look at it tuesday just gone.Finds that starter motor is no good,cooling system problem and problem with ecu on gearbox.Problem is I do want the car but would I be able to get anything from the trader as Im sure I would be covered by SOGAicon of 1979? No hp involved

    Also found out now that ring gear is damaged aswell from the starter motor problem I want to reject the car now as the cost of repair is escalating.How do I stand with this?

    Welcome.

    You are fully entitled to repairs to all the faults at the traders expense or you can reject it under SOGAicon not fit for purpose and not of merchantable quality.

    If you reject it, you 'must' do this in writing listing the problems and quoting the soga and you must not use the car again. They must come and collect it also at their expense.

    There are many threads on rejecting under the sale of goods act, so have a read around and you will learn a lot.

    Whichever you decide to do ie repairs or rejection, get that letter off with either a quote for repairs or the rejection as soon as possible.
    Do it by recorded delivery letter, try not to speak to them on the phone unless you can record the calls. If you do record, you should let them know at the begining of the call that you are recording.

    Hi thanks for reply,I do want to reject the car now and I have sent a letter(recorded delivery) today with a copy of the problems done by my local garage and stating the SOGAicon of 1979 asking for a full refund and cost of diagnostics at the garage. I have the car back home now and will not be using it again.I had half a days use out of the car in total since a week tuesday gone.

    Today had a full refund from the trader but not my garage bill.Just glad to have the refund and now I can look for a new car hopefully with no problems this time.Thanks

    Congratulations, you know now to test all the controls and ensure the test drive is long enough (at least ten miles including motorway type roads), to get the engine up to full working temperature, (that's not just the water guage showing normal).

    May you have more success and enjoyment with your next car.
