Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My vehicle was in for repairs for 3 weeks at dealership! (vehicle 12 months old under warranty with only 6,000 MILES on clock )
Went to collect it to find ,fist sized, dent in rear panel and brand new alloy wheel was damaged, they have repaired both but dent is still visible after being pulled out (very evident ripples)
They want their loan car back,i don't want mine back until it has been fixed and back to origional ,perfect condition!!
They have stated," It's the best we can get it and we are not prepared to do any more."
How do I stand legally?
Please help.
You stand in very good stead.
First take photos and if you can do this with them noticing (lots of flashes), all the better. You then 'tell' them that you want it returned in the same condition as was delivered to them.
If they refuse then you get a few quotes from other body shops and tell them that you will take it to one of those for repair and bill them and if payment is not received within 21 days you will take them to court.

Thanks for the advice, developements since last night....After being bombarded with numerous phone calls and left messages ,they have threatened me with police action if loan car is not returned before 9am tomorrow( by text),I have had legal advice ,this they can do!?
My car is trapped at dealers ,they want rid, but if I remove it ,it show acceptance of works carried out.
My whole night has consisted of letter writing to customer services -Mitsubishi and all maner of people,I am gutted mate ,
It's not really as hard as you think. Take the pictures as I suggested getting the light right so that it shows the damage.
If your car is off the road for repairs at another bodyshop, then hire a car and add that to your claim.
You should enquire about the price of a hire car and let them know that the hire cost will be added to the bill if they refuse to do the job correctly and you have to take it to a third party for repair.
Don't use the phone unless you can record the calls, always use letters as you will have a paper trail of their refusal to complete the repair to assist you if it needs to go further.
don't sign any acceptance, satisfaction note or receipt without annotating on it that you are removing the car subject to harrassement and with damage done by the garage and add a date and time.

The loan car has gone and to my suprise they have dumped my L200 on my drive, whilst I was at work.
This must be common practice for them ,I think they are enjoying it.
Get that threat of court action to them in writing as soon as possible and wipe the smile off their faces.
