I have today received a notice of legal proceeding letter from Car Clamping securities in relation to a parking ticket from 15/09/2008.
As far as I am aware I did not receive any such ticket on my windscreen. Nor have I ever been to the car park (located Kings heath, Birmingham).
I rang the company earlier before seeing this forum and was told to write a letter which I have done. Given that this is nearly two months since the ticket was supposdly issued, the man on the phone told me the details of the car park which I have googled and have never been to. I have asked for some evidence (the man of the phone mentioned this would be a photo of my windscreen)
I have however found a car parking ticket in my glove box for the 14/09/2008 which I cannot remember what for or where from which time expiry of 16:23 (the letter states the ticket was issued 16:43) however given that the date is different (i.e the day before - Sunday) I am very confused.
Any help or advice would be appreciated, the letter demands £85 within 7 days or this will increase to £131.
At this moment I would suggest the best advise would be to NOT write to them or have any further communication with them at all until they actually file for a real court hearing.
If you are correct in that the day they are accusing you of parking isn't even the correct day of the overstay, then it should be a very short hearing.

It is for first management group, does anyone know how to access car park listings for companies in a certain area ie Birmingham. All I have is the ticket number 348559.
I take it this is just a 'chance it' letter from them. not actual papers from a court ? By all means post up pictures of the letter - suitably washed of personal details (tinypic is easiest).
They are proposing to submit court papers for the recovery of an
UNPAID FIXED PENALTY TICKET
Have you asked them when did they become entitled to issue PENALTIES as a private company? Better still, wait and ask them that in court so they can explain it to the magistrate at the same time.
don't worry there would be a whole bunch of us there if they tried this on in court. mass enjoyment to watch them getting nailed, don't worry about them.
Even if you have infact exceeded your time period on the parking ticket you purchased?
As there is obviously a lot of confusion at the moment in relation to the ticket stub I have from the day before, never actually receiving a car parking fine on the windscreen and never having visited the alleged car park.
