Default Lookers Honda and a Ford Focus 55 plate

I bought a Ford Focus 55 plate from the above dealership on 21.10.08. It cost £8250, finance by £2000 part ex and the remainder cash.

I had the vehicle 2 hours before it broke down. There was a total loss of power whilst parked stationary waiting for the wife. I called the garage to advise and then arranged recovery thru my insurer. The recovery guy tested the battery which was runnig at 9 volts...not the 14 that it should be.
Anyway, the garage came the next day (22.10.08) and fitted a new battery. This lasted less than 24 hours before it happend again, whilst my wife was performing a u-turn...thankfully in a cul-de-sac.

I called the garage again who on 23.10.08 brought a courtesy car and another battery for th Ford. The driver left the courtesy car, fitted the battery on the Focus and drove it away, taking it to Ford Dealership.

I got the vehicle back today at 12:30pm. I didn't drive until I went to pick my daugther up from school at about 4pm. I parked the car, collected my daughter and returned, but guess what..the bloody engine wouldn't start...same problem...THIRD TIME.

I called the garage who in turn called FORD, who in turn called me....what good that did I'll never know. Anyway I spoke to the manager of Looker via phone while the recovery guy (again) did his thing....battery running at 9 volts...something somewhere was draining the battery.

I told the manager that it was my intention to reject the vehicle and naturally was trying to put me off. He asked if I could get it to a Ford dealership nearer where I live, as he said that in anycase he needs to get to th bottom of the problem...of course he would pick up all the costs and to pass his mobile to the garage so I'm not out of pocket.

Bearing in mind that the vehicle is less than 3 years old, has 28,000 on the clock and has has the same problem 3 times on the spin, am I justified in rejecting the vehicle? (It's still in my possession until it goes to the Ford Dealership on it's manufacturers warranty)

I'm definately don't want the car, as according to the recovery guy, the power could have gone on the motorway, with potentially fatal consequences!!!!!!!

Can someone please advise accordingly, including the Sales of Goods Act etc.

    Thanks for reading

I would not think the problem is bad enough for you to able to reject it to be fair; its just the dealers incompetence to fix it properly.
The dealer you bought it from should deal with it, however with their agreement another can sort it for you and providing you get a courtesy car I would see how it goes; Get them to prove to you it has been fixed before you accept it back though, check charging rate etc. Warranty does not come into it; its a fault and they have to fix it at no cost to you.

Contact the lookers plc head office in Manchester to log a complaint. The Lookers group complaints process is very good and you should get any matters sorted. Your first call to log the complaint will get the ball rolling - they will then contact the branch for you and investigate.

Ask to be put through to the complaints dept.
