Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have decided to reclaim the PPI from both of my loans with Halifax after discovering that I am well within my rights to do so.
I have requested the original loan agreements along with the original PPI documents (if there are any!).
I am aware the I can reclaim the amount of credit supplied for the Insurance along with the interest applied. Is there any other interest that I can claim back?
I was never told that I could get PPI elsewhere and regarding pre-existing conditions, I have had back problems prior to taking out the loan. I was not told about any exclusions and had I known, I would not have agreed to the PPI.
Also, I am still repaying one of my loans. Do I reclaim the whole amount or the amount that I have paid so far?
You have started in the right direction by getting all documents relating to the PPI and LOAN.
I am aware the I can reclaim the amount of credit supplied for the Insurance along with the interest applied. Is there any other interest that I can claim back? you want back the PPI premium paid plus contractual interest paid.
Also, I am still repaying one of my loans. Do I reclaim the whole amount or the amount that I have paid so far? On this one they should refund the PPI premium paid plus contractual interest then refinance the loan at the apr rate used when you originally took out the loan without PPI added.
Your case is very similar to mine im also claiming due to previous medical condition although mine is with the Co-Op bank.
You could claim the simple 8% interest the court would award but that is not putting you back in the position you would have been in had you not been mis-sold these policies so i would go the what they charged you the contractual rate.
I would also request all statements to these loans unless you have them of course because you need to know the dates each payment was made and the amount so that the contractual interest can be worked out on an excel spreadsheet.
