    Default query about filing for cc charges

    I am wondering about claiming back charges against Barclaycard aswell as my ongoing claim regarding Barclaysicon bank. However I notice the template letters forum have templates geared towards banks and not credit cards which do not fall under the OFT case so I guess there is information I would have to change.

    In the S.A.R it says: "I would be happy to collect the Data from my local branch." Should I omiss this in regards to Barclaycard?

    I see alot of threads here regarding PPIicon's and cca's (credit agreement?). I don't have a clue what these mean. Just wondering how different it is dealing with credit cards.

    Basically, all you need to do is amend the templates to suit your purposes - change "bank account" to "credit card account" etc.

    If you like, change the letters, omitting personal details, and we'll let you know if you are on the right lines or not.

    All help is merely my opinion only - please seek legal advice if you need to as I am only qualified in SEN law.

    Ok thx, firstly I read somewhere about sending a £1 first to Barclaycard to get the credit agreement (or together with the s.a.r. (£10)). Can I send for both of them at the same time?

    Well, if you CCA them and then they don't produce the agreement, you can't really then reclaim the charges as if you stopped paying them, you would be saying there is no enforceable agreement.

    Reclaiming your penalty chgs from BC should be relatively easy.

    First off, the jargon :-

    PPI = Payment Protection Insurance. Read about this in the PPI forum.

    CCA = Consumer Credit Act. This is where the legislation is concerning credit borrowing. When you see someone say, "I suggest you CCA them.", it means send BC a CCA request (Letter N from here - http://www.consumeractiongroup.co.uk...templates.html) to see if BC (or other) has a valid Credit Agreement for a particular a/c. This only applies to credit or store cards, catalogue a/c's and certain other loans. It doesn't apply to bank current a/c's.

    If you need your a/c statements, just use the SARicon to get them. The CCA request can follow if nec'y.
