    Default SB100 v HFC

I have the CCA request ready to go for my credit card; was using the following address but the post office don't recognise the postcode.

    HFC Bank
    P O Box 3607
    Birmingham
    B1 2XJ

Can anyone advise if the address / postcode is correct, or if I should send the request to another department.

    Thanks

Is this any good to you SB100? :

Reference ....... (your letter of xx xxx xx)
I am disappointed that you have failed to respond to my request for a copy of my (insert which is applicable) agreement to which I am entitled under the Consumer Credit Act 1974 (Sections 77−79). A copy of this letter is attached for your convenience.
I have previously enclosed a payment of £1.00 which represents the fee payable under the Consumer Credit Act.
I understand a copy of our credit agreement should be supplied within 12 working days.
I am sure you also understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.
Failure to respond positively will be reported to the Financial Ombudsmanicon Service and the Office of Fair Trading.

    Yours faithfully

The prescribed terms that make the agreement legally binding appear to be there

    they are

rate of any interesticon applied to the account (or how it will be determined)
repayment schedule (or how it will be determined)
amount of credit or credit limit (or if it will be determined later)

these all appear to be here

barring anything Ive missed, it looks enforceable

To be enforceable it must have your signatue and the prescribed terms in the same document. The prescribed terms are on page 7 and your sig on page 8. Therefore it is enforceable if (and only if) pages 7 and 8 are back and front of the same sheet of paper.

It's the 'original' - ie what they copied that matters
