Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have an outstanding Council tax bill for £228.00 from my previous property which was referred to a baliff on 17/10 (only know this because the council told me).
He put a letter through my door yesterday saying that he would return within 48 hours if I had not paid the £403.00 that was due! So he has added on £170 worth of charges this is his first visit to my home!
Anyway I called him yesterday evening as said I was willing to make arrangements to pay but, he said he will only accept the amount in fall overwise he will be round on Friday.
I have called the council to see if they will take the debt back and am waiting for them to call me back once they have spoken to a manager.
If they do take it back will i have to pay his ridiculous charges?!
Pay the council direct online, making sure you put the relevant account numbers in, or it may just be taken off of this years bill. You also need to find out exactly how much you do owe on the liability order, this will not include any bailiff charges which should be just £24.50 as its his first visit.
Do not let the bailiff in under any circumstances, keep all windows and doors locked as they can enter if one is left open and carry out a walking possesion order in your house. Also if you have a car, move it some distance away from the house or sell it to a mate for a quid, to be bought back once the tax is paid.
Hope this helps a bit.
Tip us a wink on my scales if you think I may have helped at all
OK the council have just called and said that they are going to recall the debt and tell the baliff I have paid all the money I owe the council £228.00 and that the baliff should not try and claim for costs and if they do to get a break down as they are extorinate so does that mean I might still have to pay them?
Well you could make a form 4 complaint because the bailiffs charge is fraudulent, he is charging illegally, he might lose his certificate if he has one and hopefully cease to be a bailiff.
Or you could just forget about the bailiffs - and wait to see if they actually pursue you for the money they say you owe them - and if they do - then make a complaint to the court.
