    Click onto the green sign above with martins face on this will give you step by step instructions leading you into all the templates you need, it is a little confusing at first but just play around and read you will soon get the hang of it, I have just this minute put my claim in through moneyclaim (court system) and was pleasantly suprised at how easy it was, but be careful start at the beginning i.e. the Data Protection letter this is found in the templates libraryicon. Hope this makes sense, Good Luck

    Hi, after sending all letters to Capital Oneicon, they replied with an offer ( part payment) 2 weeks ago. I declined and threatened with lagal action if I had no news within 7 days. Got reply today telling me that they do not have to repay me anything, and that is a goodwill gestureicon and their final demand, and that I should accept and not waste court time. I have started to fill in the money claim online, which is £80. Can you tell me what you think? what are my chances? Or should I just accept the offer ( 3rd of full amount) . PS: Not sure who is receiving or seeing this e-mail. Any advise would be great thank you.

    Do not accept and take it all the way, I did even though I did not feel fully competent and A&L awarded me my full charges 1,500 pounds I really felt proud and felt I gave them a little of what I have suffered. So go for it you are so close, and it is so easy to do. Good Luck

    Thank you so much for your reply, I think I needed a little push to take the next step. I am not too sure I filled in the "comments " page correctly in the Money claim online though. I just described what I did so far and how much i am claiming . Hope it works??!! Thanks again

    What exactly did you put in the 'comments' page? Did it in any way resemble this:

    1. The Claimant has an account (A/C No) with the Defendant, opened (Date a/c opened). Since (Date of 1st charge) the Defendant debited charges and interesticon in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levyicon such charges is unenforceable under the Unfair Contract Terms in Consumer Contracts Regs 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of (£0.00 = amount of charges claimed); (b) Interest per S.69 County Courts Act of 8% - (£0.00 = The interest total in 8% spreadsheet calculation at date of claim) continuing at 8% until judgement or settlement at a daily rate of (£0.00p= Amount of charges x 0.00022); 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court.

    Thank you for your reply. No, I didin't put any of that. I explained in my own words what I did. I haventcompleted it yet, so I will change everything. Does £80 court fees sound right? And Should I really add interesticon? Thanks a lot;-)

    £80 fee is for claims between £500 and £1000. You don't have to claim interesticon, but why not?

    Have you sent Cap 1 a schedule of charges?

    Fine. Use the Simple spreadsheet here:

    http://www.consumeractiongroup.co.uk...eadsheets.html


    Just overwrite the examples in the type of charge, amount and date columns only.

    The days since and 8% columns will be calculated automatically and you can use this to claim the interesticon.

    No.

    The schedule you've already sent them is fine, but when you file at court you can claim 8% interesticon and you need the s/s to work this out.

    You can file the claim on-line, but then you need to post copies of the s/s to the court
