I was over paid in April 2008, but truely belived that this payment was correct as I was waiting for back pay from 2004. Then in June I was contacted by Payroll stating that I was over paid and asking for most of it back. I asked them to confirm their figures, they got back to me asking for £300 less. I asked them to confirm this figure, again they back asking for £200 less again. It then took me to September to get payrol to admit they had made a mistake. Since then they have asked me to pay this back at £30 per month, I have stated that I cannot afford this and have offered £10 per month. At the end of September I was told that if I do not agree to pay £30 a month the debit will go to a debit collection agency, so I had to agree. Since then I decided that they could not treat me like this and estopped them from deducting any more. I also put on a greivance about the way I have been treated. At a meeting I attended I was told that my increment payment (due end October) has been suspended until I agree to pay £30 a month, or they will stop my increments payments until the debit is paid off. Any ideas what I can do. Any help would be great. Thanks
Unfortunately you will not be negotiating from a position of strength as legally your employer can deduct overpayments of wages from subsequent wages.
Don't know why on earth they would bother with a DCA if your still working there as they can just deduct from your next months salary.
As you work for the NHS you may wish to speak to your Union Rep, if you have one, as there could be a workforce agreement that is more generous to the employee in the event of overpayment.
