Lots of information on this site but not sure where I stand with a 2 default notices on my credit file from Egg.
I defaulted back in 2004 on my Egg Loan and Egg Credit Card. I have since paid off (last year) both outstanding balances IN FULL and now show as SATISFIED on my credit file.
Is there any way that I can get these default notices removed from my credit file once and for all? I tried writing to Egg asking them if they could remove them as a "gesture of goodwill" but got nowhere!
Default Notices when validly issued and broadcast by Experian et al record historical events which actually occurred, for the benefit of other money lenders. Egg have a legal obligation to make public after defaults have been remedied in full, but have no obligation to wipe the slate clean effectively to retract saying said default never occurred when it did.
I believe Experian et al will remove the entries with no questions asked, if Egg tell them to do so. As for a "goodwill gesture" for which Egg currently have no appetite, I have read of only one relevant precedent.
Poochball requested Egg for a CCA which Egg never managed to supply. Nevertheless like you Poochball paid his debt in full any way. In return Egg erased Poochball's DN without being asked, possibly out of gratitude and relief that Poochball did not make trouble over the absence of CCA which I suspect Egg may have misfiled and cannot retrieve?
Yes, the template letters will suffice. CCA request has a legal outside time limit so Egg cannot stall for ever without consequences. You could mouseclick poochball's id then send a polite Instant Message in private, and if he still logs on nowadays he may have additional tips from one who has gone the route.
thanks mate - any idea whether I should give them 14 days or 28 days to provide copies on the DN and credit agreement?
Ive seen 2 template letters on here asking for the info, one giving 14 days and one giving 28?
I believe that the only way to get a default removed is it it was in the required format containing prescribed information. Problem is that unless you have a copy of the original documents that were sent you Egg do not keep copies and cannot send a copy.
Having read through various threads on this site, I've found a few template letters that have been used asking for info and to (try to get) defaults removed.
The first letter is asking for a copy of the original CCA and DN - if Egg (in this case) can't provide then the letter asks them to remove the default notice.
If this gets no-where, Ive seen another letter posted by Surelybonds (I think) that requests this information via a CAR?
