Hi, can somebody please help me. My husband pulled the TV forward to read the gas meter and as he was standing up behind the TV he knocked the TV forward from the stand, and the TV fell onto the floor causing a loud hissing sound.

We contacted the Royal & Sunallince to make a claim and they sent a claims specialist out a few days later. He in turn arranged for the TV to be examined by CIIS and this is where are problems have started. They collected the TV the following week (29-09-08) and sent their report back to R & S I don’t know exactly what it said but in their view the damage couldn’t have been caused by the fall!!

This is completely untrue; the TV was working perfectly before the accident. This is a valid claim but now they are sending a Senior Claims Investigator out to see us next week to discuss matters with us.

In their letter it says “For the avoidance of doubt, please note that all enquiries and information sought are without prejudice both to our rights under, and with regard to the validity of, the insurance policy, and our position is fully reserved”

What does this mean exactly? I think they do not believe my husband and myself that the accident happened this way, How can we prove this to them when the report from CIIS states otherwise? We have never made a household insurance claim in well over 15 years.

Any help would be gladly appreciated.

Just tell them the truth.

 

It is up to them to prove that the claim did not happen this way.

 

The Insurer has been told something by the TV people which suggests the TV could not have been damaged the way you said it was. It IS possible for these people to be wrong and that is why a senior expert has been sent out. They will take a statement from you with more details.

 

Their letter "for the avoidance of doubt....." is essentially saying "just because we are sending someone out, it does not mean we are accepting your claim or anything. Furthermore, we can cancel your policy or uphold any rights we have under our contract with you".

 

Check your insurance policy booklet. It tells you in there what this means for you.

i would also ask them for a copy of the report as they think there is doubt

also state that you may require a independant report carried out and see what they say

PS i remember when my motorbike was nicked it was found couple of yards away in the bushes was told take it home cover the bike and someone will come out and finger print it , so i did and the came out well blow me on the weekend the bike was nicked from the back garden again has i had chained the front and back wheel didnt think anything of it so back on the phone to the cops the took a report so i phoned insurance company up they sent out a form filled in off it went in the post,

2 weeks later they sent out a senior investagtor to take a report he also asked to recorded it i told him fine i will also record it and i did.

after he told me we wont be paying out as we think you trying to screw us and its a case of fraud and if you presue the claim we will pass it on to the police i stated fine by me so you accusing me of fraud ???

well thanks do you want to know where i was on the night the bike was stolen?? NO REALLY

well i will tell you i was in the police HQ in the CCTV control room and if you go outside you will see at the bottom of my road there a CCTV and i have a copy of the night in question as it was caught on there and the reason i didnt call my wife was she was along at home with 2 kids 1 & 4 and frighten her a call went out (not by me but another controller)to a cop car the bike was loaded into a van with no lights so we couldnt get the reg No

So many thanks for your time but im off see a solicitor in the morning to sue your company for being accussed of fraud as i have 3 PC 1 duty inspector to give statments where i was on the night and we all watched it being nicked

OH CAME THE REPLY MAYBE IVE MADE A MISTAKE

yes i had i sued them for 5k out of court bike was only worth £900

THAT WILL TEACH THEM only sad part i watched my bike being nicked and couldnt do nowt about it being 11 miles away just glad it was only the bike
