I hope someone will be able to help me.
A couple of months ago one of our small departments (team of about 5 or 6 based in Head Office) was made redundant. As far as I know, they had their consultation and then left.
Shortly after that about 20 front line staff (based in a selection of our centres) went through the same thing.
Then shortly after they left my department was informed of redundancies. There are about 15 of us all based in Head Office. We went through our consulatation process and earlier this week our roles were made redundant and have since left.
Apparently our redundancies don't fall under collective because the front line staff were based in different locations and because our consultation had started after the other Head Office team had already left. I know that Head Office are potentially going to be going through further redundancies.
So whilst they maybe within the law, would an employment tribunal not look favourably on them. The HR have structured the redundancies in such a way that us as employees are losing out. I still think that given the number of people made redundant and since its within 90 days we should at least get the 30 days consultation period and not the 2 wees we were given.
Also during the all these redundancies and just before my departments, they were recruiting to fill other positions in the company. surely that should have been frozen and offered to us first. We were only offered roles first that opened at the time of our consultation period.
Another point, my final letter of redundancyarrived stating:
"...unfortunately it has proved necessary to declare you redundant."
Are they allowed to say this? Surely its illegal to say I'm redundant. My role is redundant!
Given all these facts, I want to know where I (am all my former colleagues) stand.
I don't want to go back and work for them but would like to complain and go to the Employment Tribunal and seek compensation. Can I do this and what is the process?
