I wrote to MBNA and Barclaycard in December 2007 re PPI mis-sold to me as I was self employed at the time of taking out the credit cards, they knew I was and still insisted I took this out.
I have had the Barclaycard since 2002 (still open) and the MBNA card since 2004 (since closed).
On writing to them twice they told me to go forth, as expected, and I referred this to the fos in February 2008. I have heard from them a couple of times, saying how busy they are. (This is a good thing, get the b***rds) How long should I leave it before chasing them up? Dont want to shoot myself in the foot

also recieved my acknowledgement from fos today, it says... "we are currently recieving very high volumes of enquiries and we will provide you with a full response as soon as we can"
Looks like i could be in for quite a wait.
i have received reply from fos saying. .
"we have sent the busines details of your complaint and have asked them (HBOS) to deal with the matter. They should issue a final response in writing within 8 weeks. If i then feel that they have not put things right, or if i have not heard from them after 8 weeks, please return the complaint form"
So that gives HBOS another 8 weeks to mess me about.
Thats just what I get. At least they're busy hope they find in your favour!
You will have received a contact name and telephone number on your response from the fos. I would ring them for a chat to see how things are going and to ask if you can help them with more information.
Otherwise, as they really are inundated, it may take a few months.

Yes, that is what happened to me with one of my claims. They are giving both sides the opportunity to sort it out between themselves and you can view it as an opportunity to put your case for mis-selling to the lender, ask them to provide evidence to the contrary and show how they have not breached regulations in selling.
If they are unable to do this, then you forward all your correspondence together with copies of the lender's responses to the FOS and they continue to investigate your complaint.
If the FOS do not find in your favour, you may then take your complaint to the courts.
It will take a while, but that's to be expected unfortunately.

RBS have just made me an offer which falls some way short of what I'm looking for and I'm now mulling over how best to proceed.
With that in mind, I'd be grateful if anyone can help me with any of the following:
(1) Some of you have received a reply from the fos saying that they've forwarded your complaint to the lender. Is this occuring even in instances when you've already contacted the lender and they've refused to acknowledge that the PPI has been mis-sold?
(2) In instances where this is happening, what sort of time span is there between you first writing to the FOS and them writing back to say they're forwarding your complaint to the lender?
(3) If I decide to complain to the FOS does that mean the offer I've received is no longer valid or can I, at a later stage, decide to withdraw my complaint to the FOS and take the original offer?

This did not happen in my case, I complained to RBS got a load of tosh and delays.
1. Complained to the ICO (no result yet since complaint in March 08 despite several phone calls) Their targets are not being met ( I know they are busy but they should notify revised targets)
2. Complained to the FSA who noted the complaint, could not deal with it but requested permission to pass it on to other regulatory bodies.
3. Complained to the Office of Fair Trading and got same response as 2.
4. Complained to the British Bankers Association (BBA) the response was not worth the Postage of recorded delivery to ensure they got the message
5. Complained to the FOS three times now one success after refusing a goodwill offer was increased via FOS by 30% from £2,600 turned down to £3.800+ after FOS complaint.
My message is Be patient We all want OUR own money back and the sooner the better. The financial institutions however are using whatever they can to fight back. After all £1.4b in mis-sold PPI is a lot of money to fight for. Let us give them a fight
