Hi, I have recently written a letter to Lloyds requesting they refund me a PPI policy (£4000) which they insisted I take with a loan. They had declined my loan request when I applied by phone 2 weeks prior to taking the loan out so I made an appt at the branch who said thy could only give me the loan if i took the protection....the advisor kept going to negotiate with manager and said these were the terms. Lloyds have rejected this as the loan agreement says "optional" ppi. They said I had no option, no ppi = no loan. I cant prove what was said though....any suggestions???? I also advised them at the time that I was covered by income protectin, my partner had arranged this, we have since cancelled this protectionas we were paying almost £100 a month in insurances but Lloyds are asking for copies of this policy. I'm lost as to what to do now?

Firstly you will need to send Lloyds a S.A.R which you will find in the stickys.
When you get some corresponse back from them come back and we will help you from there.
You are not alone with the provider stating that they never told you it was compulsary in order for you to get the loan. This is the same in a lot of PPI Policys.
Absolutely agree with Nick here; get all the info you can from them regarding the loan by sending a SAR.
You can request: a true copy of the Application Form as signed by you; the Terms & Conditions of the Loan including those relating to the PPI element of the loan; a true copy of the Credit Agreement as signed by you; copy of the Demands and Needs Statment provided by Lloyds at the time of taking out the loan which would and should contain all information relevant to your personal situation at the time of taking out the loan and containing all the Qs they asked you to see whether the PPI suited your needs, such as any pre-existing medical conditions, and any if so what existing payment protection cover you had.
(I bet you they can't provide the latter but they should have done).
I can wholly believe your tale of being pressurised into purchasing something that a) you didn't want and b) you didn't need - shoddy business practice on the part of Lloyds to say the least
Yes, you have been mis-sold PPI and yes Lloyds have breached many of the points contained within the FSA regulations on selling PPI together with much of the Banking Code of Practice ....
After your SAR, you can send a very stern letter to them. Shout if you need any help with this.
Also, it will help you if you read this PPI which will help you pinpoint the exact areas in which you feel you have been failed by the lender.

Just a little thought, if they require information regarding the evidence of other insurances. Maybe write to the other company asking for assistance with this:grin: Just a letter to confirm that you had and where paying for this:grin:

Thank you so much....I didn't realise anyone had respond as I am new to CAG. I did reply to them but that's when they said to go to FSO. I probably have copies of letters confirming my cover that was in place. I will send off the S.A.R. They have already sent me page 6 of a income and expenditure form and a copy of the credit agreement but I thought there would have been a form signed form stating I have been advised the benefits of the PPI and wish to purchase. They said I would have been provided with a statement of price before purchasing but did not send that when I requested.
I feel a bit out of my depth so really appreciate your support.
PS. They respond the same day as they receive my letter each time but never answer my questions!!

Regardless of this keep on asking those questions:grin:, the fact that they are avoiding these question and they will not enter into a truthfull and sincere dialogue with you, although frustrating, it is all the better for you, if this proceeds to the fos or court

I've received back none of this and just a statement of any charges and a letter saying I can send that to the FSO and when everything has been decided in court about bank charges then they will respond!!!! This was not what I asked for and it seems they have not even read the letter properly.

Even if it wasn't and you asked for all information they held, then have not fully complied with your request and if they have passed the forty day timescale they are in breach of the data protection act 1998.

Yes that was the one. They have responded within the 40 day timescale, they received my request on 17/11. They only sent a print out of any bank charges, nothing at all to do with my accounts or loans. Is it too soon to send the non compliance letter?

I believe that there is a choice of 2 or three letters to send to them regarding non-compliance. I have used the you have send me some info but I require everything and no it is not to soon, it is just a polite reminder of their obligations

Dondon don't let them fob you off with something Lloyds once tried with me in that they only sent 4 years worth of statements and included a form for me to sign if I wanted them to go further back telling me they had a further 40 days to respond once they received the form back
What adress did you use??
My last SAR request went to their compliance team and I got everything back - 2 times packages the size of plain paper reams
The SAR should also incude contact details form when you took the loan out - they can be very enlightening - mine incuded some out and out lies and were convienientely missing a few other rather incriminating ones

When I say contact details I mean the log of conversations had with you either by letter phone or face to face - and they don't tend to log the ones where they know they have been deliberately dishonest - funny that

Hi RedVixen, I sent it to the Customer Service Recovery Centre, there address was provided in a complaints leaflet and as I thought they should have my complaint on file they would be able to see why I was requesting these documents. There were 3 loans between Nov 2001 & Jan 04, as 2 were refinanced and all with PPI. The 2nd loan taken was arranged by their customer relations after a commplaint to the FSO as they had made so many errors on the loan account (took 2 payments, refunding 1 then harassed me for 6 months for the payment they refunded). This 2nd loan was arranged by my partner who had no authority to deal with this in writing but they still dealt with her!! This is probably why they may not wish to hand over these documents.
The address I used which got a much sharper response was their compliance team. But the address isn't one they advertise.

For now as you have already sent one and sent your £10 I would send the non compliance out the Customer Service Recovery team I suspect are only used to dealing with PPI claims It might be worth Ccing it to the above team but that relys on them sending it over to them - that is the one I used a couple of years ago and got a poor response

Well, sent off the Non compliance as suggested and mentioned the fact that I have had 3 loans with Lloyds since Nov 2001 but they had omitted to send any copies of documents relating to this or notes. Just had a courier deliver 7 years worth of statements!!! No loan agreements, no copies of correspondence (even from the time I went to Ombudsman previously)...This is the 3rd written request for loan documents which they have ignored...What do I do now?
mm interesting - there may be another package in the postal system - I got 2 - 1 had all the statements (9 years worth) the other had everything else. I got copies of all agreements that they still held

And check through the statements - the only difference between my current account ones and the loan ones was the account numbers on them - they still gave me details of PPI

I'll see if anything else comes. The response was from my local branch, looks like they have not even read my non compliance but just asked the branch to provide statements. They provided a loan statement but no agreements. The statement was for a loan from 2001. They also included a letter suggesting I bank online where I can check my statements etc!!!
They collect different information form different departments - I had lots of different bundles all labelled with this info has come form here and this has come form there
