Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Apex have written to me at work
They do not have my home address - I guess?
They state:
"We would like at this stage to avoid passing your account over to our business support solicitors"
Apparently this is my final oppotunity to make payment before they go legal!
I had the same letter approx three weeks ago!
It is addressed to my ex partner (not been with her for over two years) FAO myself.
I do remenber signing as garantor for a loan she took out when we were together.
What do you think?
About how long ago was the original loan, and do you know who the original lender was? Do you have any idea how much it was for or how much is outstanding? Don't give exact figures, something like £2-3k would be sufficient information.
How might they have got your work address? Did you work there at the time the loan was taken out or might your ex have given it to them?
It is possible that you could be sued for any amount outstanding if you did sign as guarantor but I don't have much experience of dealing with Apex so I don't know how likely it is. Have a search around the forum for other threads involving them to get an idea of what their usual tactics are.

I am not an expert in law, finance or any related field, I just read a lot. Any advice is based solely on what I've read so please don't take it as gospel without checking it out yourself.
I prefer not to give advice by PM. If you want me to look at something, send me a link to your thread, and if I can help I'll reply on there.
Thank you for your prompt reply!
Seem to recall a loan of about £3k from the AA (Yes - the car people) three years ago.
All repayments were made by my ex, but I dont know how much she paid off!. I must have given my work address when I signed as garantor!
They are after approx £5,500!!!
Be careful not to give them any more information than they have given you, e.g. if they haven't mentioned the name of the company you allegedly owe, you don't mention it.

I'd suggest that you use an electronic signature rather than your normal one. In these days of PC heaven it's quite simple to copy and paste your signature onto any document.
If it is for a loan and it is in your ex partners name then either send them their address, or if you wish send them a cca request and ask them to prove that you have anything to do with it.
also i see you state the loan was for £3k and it is now £5.5k, so In would be asking for a set of statements to see where the extra 2.5k came from

I have now received a letter from a solicitor acting on behalf of Apex.
They say that i have 72 hours to contact them with a repayment proposal or they will advise their client to issue a claim for recovery in the county court. Plus costs etc.
I dont have an address or know the wareabouts of my ex partner.
Apex do not have an address for me appart from my place of work.
Maybe I should sent a bogus letter telling them that I know longer work here? But I guess theuy could ring and check!
send it back saying that the person they are trying to contact does not work at your work place and that unless they are specifically trying to pin the debt on you they are now starting to cause harassment and that you require by return their official complaints procedures.
or if they consider the debt to be yours then you require by return the consumer credit agreement alledgedly signed by yourself

Keep all your correspondence nice and safe though, just in case.
