    Default Getting JSA but can we get IS instead?

    Hi

    I have been on JSA for 1 month now since being made redundanticon. My wife is 9 weeks pregnant with our third child and has been admitted to hospital with Hyperemesis Gravidarum (extremely severe morning sickness - I am talking unable to keep even water down and has ended up on a drip in hospital as she is so dehydrated) She has had this in both her previous pregnancies and has ended up in and out of hospital all the way through because of it.

    I am currently claiming JSA for us in my name but as a family claim she has been signed off by our doctor for 6 weeks and will more than likely be off sick for the entire pregnancy. She doesn't work as she looks after our two children.

    My question is can I come off JSA and she claim Income Support for us?

    The problem I have is that whilst she is in hospital there is no one else to look after the kids so I am not available to actively seek work. It is likely she won't really be capable of looking after the kids on her own even when she comes out of hospital so could she claim Income Support to cover us if I came off JSA?

    Please help us.

    Yes, you should get income support under the category of temporarily caring for a child while the person who usually does so is ill or absent. At the very least while your wife is in hospital but if she is too ill to manage you can argue that you still have caring responsibilities.

    In fact I believe you can avoid the paperwork by continuing to claim JSA without having to be available for work, if you fall into an income support category.

    If this is going to continue for the next seven to eight months, I would visit your local council welfare rights officer. I know there are some instances when pregnant women are entitled to Incapacity benefit type benefits.

    As this is going to go on for the whole pregnancy, you don't want the Jobcentre to get in umbrage at your next interview! Better to make enquiries now and be on firm footing if they DWP act up.
